After sold of the above land, during 1980's our grandfather migrated from Orissa and applied for ST certificate in Andhra Pradesh, but concerned MRO not provided ST Certificate and he enrolled the caste as BC D, lack of sound mind my grandfather accepted the same. Now can we approach for ST certificate at Orissa as our forefathers are belonging to ST.

Power of attorney

Respected all,

My friend father has signed a Notary Document titled as "Power of Attorney" and the same has handover to third party of land dispute settler for the settlement of their land from others. This matter no other family member known. In the document it has mentioned that if the land settlement done by the third party, they will be entitled for half of the share of their entire property. Actually the property they acquired from their forefathers. Now the question is the document is valid without any registration and without having their other family members consent. The third party person took his father to Notary Advocate and given his consent. Kindly clarify,

Help us.

Non practicing advocate

i had enrolled with a state bar council in 2005 but have never practiced in court nor was engaged in any other profession / vocation. I depended on family earnings and due to my mothers ill health and disablement had to nurse her and look after the family. Now my mother is showing improvement in health and I would like to start practicing law as my profession; knowing well that 10 years of my life has gone away and I am ridiculously late in joining my profession. Given the present rules of practicing will I be entitled to get certificate of practice? If not how can I pursue the authorities or what should be my course of action? Please guide me.
Regards,Reena

Pagdi system - commercial use

Hi,

I hold a room in a pagdi system chawl since 3 and 1/2 years. Since last 6 months I have rented it to a friend who is a CA and he is using it for practicing his profession. There are 5 rooms including mine, out of which, 4 are being used as commercial.
Now, the landlord says that everyone needs to vacant the room from commercial usage, or else the BMC swill seal the rooms.
He has been saying this since last 6 months but no action yet. But now, he has brought some bmc papers (assesment report) and says that we have to pay some penalty. However, when I checked the papers, they seem to be a notice of tax payment pending from his side towards BMC (we have been paying the rent on time to the landlord). The landlord also says that they will come for isnpection on 10th sept and if the room is still in commercial use, they will seal the room.

I want to know just 2 things:
1. Can BMC officials seal the room in this case?
2. Should we pay the penalty amount he is demanding?

Please help
