Sec 21b(2) of hma

Dear sirs, On the next date I want to file my request under sec 21B (2) of HMA for below reasons. Kindly clarify if I need to file it as petition or application with the family court ?

In my case the petition and summon was issued to the respondent in May 2014 and also the exparte evidences was ordered by court on the next date in Oct 2014 but until now the court has not proceeded for tendering ex parte evidences. Under sec 21B(2) HMA, Every petition under this Act shall be tried as expeditiously as possible and endeavour shall be made to conclude the trial within six months from the date of service of notice of the petition on the respondent.

Where the builder could not handed over flat with in the prescribed time as per agreement then is this matter of consumer forum or breach of contract civil jurisdiction ?

Succession certificate

Sir/Madam,
We have applied for succession certificate in the name of my mother last month for a flat at thane which my deceased father was the owner he had not made any will neither nomination,, how much time will it take for us to get succession certificate as the lawyer has said maximum 6 months,, and in case the court publish advertisment in newspaper regarding the Transfer of property within the time limit of 45 days do some other person from the city which are unknown to us fill the claim in court and demand money from us?

Hra eligibility for own house.

Hi,

This is Patil Gunavant M. age 35 yrs. working in Public sector defense unit in nasik.

I have purchased my own new house in 2009 at nasik through 20 yrs. of home loan and i am staying/ residing in that my new house.
But As per my entitlement in company i am eligible for company quarter for accommodation. accordingly they have offered the quarter for me .
Due to my residence at my own purchased house it is not possible to stay at company quarters.

accordingly to my denying company has given in written that i am not eligible for HRA reimbursement(20% of basic pay) due to sufficient nos. of quarter is available.

So Kindly suggest me what i have to follow to reimbursement of HRA amount(20% of basic pay)
1. shall i have to take the quarters ? or
2. i have to file the complaints ?

Accused offer for hostile

In an FIR us 420 , accused approached complainant and shown him bank draft in his name for cheated amont with interest and asked complainant to give hostile statement in court then he will give bank draft to complanant. Complainant refused. Whether offfer of accused was lawful. How can complainant get his bank draft

Can a writ be filed by workmen of private company against a

Our management has decided to close down a industrial unit citing losses due to lack of market of our product.
The management has also shown that there is a substantial amount payable to a PSU bank, which has charge on company's property.
We the workmen of the organisation want the unit to run, as there is potential market for product we make but management has not only intentionally not tapped the market but has fudged accounts and shown false losses.
We the workmen along with our trusted investor, who wants the company to run, are interested in paying off the dues to psu bank.
Can we file a writ?
Who are to be made party to the writ?
Workers, management, bank, investor?
Or what are the options available to us in above situation?
We along with the investor are willing to pay off all liabilities.

Foreign will & probate

My uncle died in UK leaving a will. His daughter was made the sole Legatee/beneficiary of his House property in Chennai. This daughter/Legatee & a son were named as Executors of the will. The son as a named executor applied for Probate in UK & has been granted Probate.
Now, the scene shifts to India & more specifically to the Madras High Court. My query is- On the basis of the Will & the Probate granted in UK, can the Beneficiary/Legatee appoint me as her Attorney to seek Letter of Administration and all other related work connected with the disposal of the property & repatriation of the sale proceeds to her London Bank A/c. Thanks.
