What to do ??

In 1964 my grandfather A was given a license to enjoy a rent-less stay in his house by his elder brother B. This was just a verbal agreement that whenever ‘B’ or his successor’s needs the said portion it will be vacated and handed over to B’s family.

In the year 1973 A passed away. Meanwhile in the year 1979, the local municipal authority mistakenly put the house tax of the said portion against the name of A’s wife AW (my grandmother). This was corrected after the series of written objections by B, from the year 1979 till 1989. In 1989 the house tax of the entire property was restored back in the name of A. In the year 1993 AW passed away, after which A’s son AS and his family kept enjoying their stay in the said portion.

AS and B, both passed away in the year 2010. House tax of the entire house was transferred against B’s wife BW. In the year 2011 govt of Uttarakhand introduced a free-hold policy to get the property freehold. BW applied for the same, which was objected by me in Jan/2012.

Later in 2013, while searching the old papers and bills we came across a document “Zubani Khandani Batware ka Yaddasht-nama”. This document is dated 03/11/1977 and says that A and B came into a verbal settlement in 1964 that the portion of house each one is residing in belongs to them, and the doc was needed now so as that no conflict arises in future. The document is signed by my grandmother AW and B. This doc is neither notorised nor registered, just on a simple plain legal sized paper. This doc has 2 witnesses, no. 1 is the eldest brother of A & B, and no. 2 is my maternal uncle. Witness no. 1 died in the year 2012, witness no. 2 is still alive and I have taken an affidavit from him saying that the above document was made in front of him and he remembers to sign it. This affidavit is notarized in Delhi.

Now B’s wife has served upon us a notice stating that the license to stay in house is revoked and we must vacate the house. She has also moved to court making my mother as defendant.

What should we do? How much is the document dated 03/11/1977 important? Does it hold any good as it is unregistered? I feel BW made a will in favour of his wife, but the will is also unregistered.

Documents after property deal

Respected sirs,
after adhoc payment from a developer for a property deal original papers of the property can be handed over to the developer or not?
or it should be given on completion of the project?
please advice.

A matter before supreme court.

Respected Experts,
I have a case in Supreme Court. In that, the Court has heard the arguments of both sides and reserved for orders.
In this we have missed to submit a question of fact on one Act. Can we file written Arguments with the permission of court.Or how i could mention about the Act. What procedure I have to follow. Can you suggest me a suitable one.

sir eas case mai kya hota hai ek goverment kanngo jiska retirment 6 month baad hona hai uski accident mai death ho jati hai ab unka ladka sarkari nakri chahta hai. ab kya hota hai ki jinki death hui hai unki ladki bhi sarkari teacher hai jo ki unmarried hai per rajasthan mai yeh kanoon hai jiske ek bachha sarkari naukri mai hai to dusre ko nahi mil sakti kya aap logo ke paas iska koi upay hai. pls reply

Dear Sir, if dowry case is filed against a person and he wants to apply in Govt. Job or want to join in Govt. Job then he can apply or join the Govt. Job?

Clubbing of petitions

in case where wife files petition of restitution of conjugal rights and the husband files petition for divorce at their respective places of residence, and the court clubs both the cases as one then which court has the jurisdiction to try the case? the wife's court clubbed the petitions. what is the law for it? need to know asap. thank you.

Remarriage after obtaining divorce

sir, I got divorce in highcourt on 1st June.We both parties initiated negotiations but the negotiations failed. I got remarried on 11th september. Now my ex wife is preparing to approach supreme court. Whether my second marriage is valid? What should I do now? It is known to me that the appeal period is 90 days.Will supreme court allow the case though the appeal period is over.

Esic applicability etc

TT P.LTD IS A MANUFACTURING CONCERN IN PUNE HAVING 30 EMPLOYEES OF WHICH 10 ARE HAVING SALARY LESS THAN 15000
BUT THE COMPANY HAS TAKEN MEDICLAIM FOR ALL EMPLOYEES.
1)IS THE COMPANY REQUIRED TO TAKE ESIC REGISTRATION?
2)IF YES,WILL IT HAVE TO PAY ESIC CONTRIBUTION FOR THOSE EMPLOYEES HAVING SALARY LESS THAN 15000?
3) WILL THE COMPANY NOT BE EXEMPT FROM ESIC SINCE IT HAS MEDICALIM FOR ALL? IF EXEMPT,ANY FORMALITIES FOR TAKING EXEMPTION?

Leakage in bathroom to lower flat

Hi,

I stay on 2nd floor in my apartment.
There is a leakage in 1st floor flat from my bathroom.

I want to know who should pay for the repair charges. Do I need to pay for complete work or 1st floor flat owner should contribute in the repair work.

More info.
1. MY flat is in a co-operative society.
2. I am paying monthly maintenance to society.
3. Its a 7 year old building. (So I don't think it is because of some construction problem)

(In some posts I see replies from Ajay Sethi in which he mentions that both flat owners should bare the cost 50 - 50. So if it is a law then can I get some related document which I can show it to 1st floor flat owner.)

Driving licence

Can I appoint a paid driver for my personal car (Ford Figo) who has a driving license MCWG , 3W-CAB , 3W-NT? I don't have any idea about that. Please inform the rules of Motor Vehicles Act on this ground.
