Please help us

Dear Sir,
We dealing (trading business) a person last 5 year, this is the credit basis. I purchase goods from him and he purchase goods from me. in june 2014 I gave a cheque of rs. 1 lac for his financial need in favor of his firm and because some reason before cheque date I request I can't clear it and I e.mail to him please return our cheque. this matter is closed that time.
Complainant don't have any outstanding on me but in sep. 2014, 2 days before exp. of cheque date he present our cheque and cheque bounce in insufficient fund and he filled NI act Case on me and my firm with some false account statement.
In dec. 2014 complainant payment us rs. 30 thousand by bank draft in favor of my firm in regards of our payment reminder letter.

My question is this if he filled me NI Act case in Sep. 2014 then why he payment to me Rs. 30 thousand in Dec.2014??

this 138 case is maintainable or not??

Consumer dispute

Dear Experts,
If a consumer feels that there is deficiency in the service he ought to goto consumer forum... My question is, can he file a civil suit for recovery of the value of the goods/services along with compensation for mentol agony, without going to consumer forum.... I'm facing such issue...pls advice me to come out from the civil case...

Fixation of pay after returning from lien

Being a permanent Central Govt servant , after selection through UPSC to another Deptt of GOI, is allowed to keep lien in the parent Deptt. I have gone to a higher post with different scale. After two years , returned to parent department in the lower scale. Whether, the pay (basic) being drawn in the new department will be protected in the parent department in the lower scale after return or fixed as usual after adding 2 increments on the last basic drawn in the parent Deptt.

Format of final petition

Sir,
My case is on the final stage at lokayukta. After 2 years of war the university is now releasing my withheld result. Sir I need to file a petition to claim compensation and action against these respondents as they have ruined my career and life. please tell me the details as i am the party in person for my case.
Should i have to file interlocutory application for compensation and action against the respondents . if other please tell me as the next posting is to be held within one week.

Notice u/s 441 ipc

Sir,

Section 441 IPC speaks about the criminal trespass and the same was amended by UP Govt. in 1961 where the requirement of Notice was there before implementing the section.

If we go through the said section it is divided into two parts.

Whether the compliance of issuing the notice is mandatory for both the parts of the section or it applies to either one only?

Power of attorney

Dear Experts,

I have got different advice on preparation of POA in a matter hence i need your help and guidance. the fact is ....

that two cousins jointly purchased a property in Mumbai. out of them one is a resident of India but working in a firm in European country and other is a citizen of Singapore. now they are coming to India for few weeks and want to execute a POA in favour of a person who is residing in Mumbai and is the Father-in-law of the person (from said two cousin) working in European firm. they want to execute the POA for all right except the right of selling of the said property.under the circumstances i got the following advice

1) To prepare two separate POA for both cousin and one POA should be sent at Singapore and get notaries from Indian embassy and the second POA should notaries in Mumbai from local notary.

2) To prepare One common POA and notaries in Mumbai. the registration of the same is not necessary as they are not executing the right of selling of the property.

3) Only one power of the first holder is sufficient and the second holder's power is not require when there is no selling right.

4) Prepare a common POA and get it registered at Mumbai only.

Dear experts I become confused what should I do? Please help me.
