Dear Experts,
My Builder charged Rs. 1.5 L under the account " TNEB (TN Electricity Board), CMWSSB (Chennai Metro Water and Sewage Service Board) and Incidental Charges.
We came to know that the builder paid only INR 8000 to TNEB and nothing to CMWSSB & the area is not coming under CMWSSB map also.
Now the builder says the amount is used for development purpose.
Can he claim that way. We are planning to approach Central Crime Branch, Greater Chennai Police. Is it correct?
My Maternal Grand Mother is 75 years old now. At 2011, she wanted to give some of her property to promoter for development purpose. And she provided a site plan to promoter. Based on that plan promoter made an agreement (Notary Registered) with my Grand Mother. And demolished everything on that property. And gave a loan of 4 lakh for making a house at other property to stay upto devlopment completion. After some day we saw that promoter submitting a wrong site plan to municipality, it is conquering some of gov place, so we request promoter to solve the problem. But he deny to solve it. And also he wanted a boundery declaration and power of attorny with his proposed boundery. But we stay with our place, and say that, to take the power of attorny and boundery declaration he have to create a accurate site plan and accurate boundery. Suddenly in Nov, 2015 after 4 years of the agreement he send us an advocate notice, stating that we are not giving the boundery declaration and power of attorney, so he can not pass the building plan. And he want the money back with other expenses, he demands total of 8 lakh without stating the proper purpose of 8 lakh. Also he stated that, otherwise he can bring civil and criminal case against my grand mother if she do not give the money or power of attorney in 15 days. Can you please tell me what should we do now? My grand mother is very ill, she can not see properly. This advocate notice is breaking her more. Please help. And Thank you very much in advance.

Respected Sir,In this case a Man and his wife have marital dispute, they have a girl child and the Man wants to divorce his wife due to her violent, abusive and immoral nature. (Audio Proof, Phone Recording available) They both stayed in a rented house near the locality where Man’s mother resides. The man is presently not staying with the wife as he wants to divorce her and is staying in his sister’s house in the same locality, the Wife is staying with her 6 year old daughter in the rented house where both Man and wife stayed.
Few days back when the Man was at his mother’s house which is owned by his mother, the Man’s Wife came, abused the man, the mother in filthy language, threatened to kill herself and her daughter several times and threatened to put the entire family behind bars by killing herself and her daughter, demanded that the Man transfers his Mother’s House in the name of his daughter(so that as a guardian Wife can Take control of the property till the child turns 18 years)then only she will go from there, she said she had eaten pills the previous day (attempted suicide). There is 30 minutes audio recording of the entire episode, one of the lines the Wife said to her 6 year old daughter is “ Babu agar mai aapko train ke saamne fek do to aapko dard nahi hoga na”, the daughter said ‘Hoga”, then Wife said “ agar mai aapko medicine deke maar doon to aapko dard nahin hoga na, inko nahin hoga, yeh to pura din apni maa and aur behno ki **** mein Ghuse rehte hain” in another sentence while discussing the custody of the child the Wife is saying ”mai bacchi ka murder kardoongi par tumhare haat nahin lagne doongi”
The wife in the entire audio of 30 minutes is abusing and threatening. Wife even called the police who took wifes side and threatened the Man, at that time the Man did not know that the other children in the house were recording, he came to know in the night when he came back from Police station.
Now the Man doesn’t want to go to police and wants to file a private complaint on the basis of the audio recording and phone call recording, the query is:
1. Should the Man and hisMother file two separate complaint to the Magistrate or both of them should file a single petition jointly. The sections that are made out are of IPC 182,323,352,504,506 Part 2,509,309,451 and Section 23 of Juvenile justice act.
2. Can the same audio recording be used for filing divorce petition also.
I know the facts of this query is quite lengthy, Please guide, Thank You in advance.

Namastae experts,
I am unaware of legal terms but my problem is that my father and my chacha (father's brother) have a case running in district court. we have won all cases in SD court and now chacha has appealed against orders in Session court. problem is that despite being correct,my father has to go on every hearing while my chacha puts an application for extension as he doesn't appear and his lawyer files an application. it is same for almost 2 years now.my father is aged and can't appear but still he does.he simply goes for news that opposite lawyer has filed an application.we talked such matter from our lawyer to demand speedy hearing but he denies. his junior told us that he doesn't act against the union.this is some sort of understanding between our lawyer and lawyer of my chacha.
my chacha knows he can't win the case so he is playing. i am in job so i can't be frequent as well. we talked to judge and she advised us to get an application from our lawyer. but our lawyer is saying such application for speedy hearing or application against the acts of my chacha to skip dates cannot be filed.he is doing it out of some bonding between lawyers.can you suggest me the solution.my father is 65 now and he can't move such distance on every hearing.
please help.
