Hello All,
I am looking for some legal advise. I have been married for 11 months now. When I look back at the past year, I feel like I have made a huge mistake in choosing my partner. My wife picks up fight for no reason and this has been going on from the time we have married. I have given enough time for her to change her attitude but things seem to be going from bad to worse.
Due to constant fights our marriage has not consummated. She always complains that it us painful to have sex. So there has been no intercourse. I have taken her to a gynecologist but to no avail. At this point of time I am no longer interested in the relationship.
I have read that non consummation of marriage is a strong reason for divorce. I have all the medical prescription from the gynecologist. How do I prove that she is not willing to have sex with me? Can I apply for a divorce now ? Do I have to wait for 1 year ?
Dear Experts,
My sisters husband filed a case of divorce on my sister 14 months ago on basis of medical history of my sister. My sister was having a medical condition which is not severe or dangerous. It was an arranged marriage and my sister is healthy but she kept it confidential and didn’t tell anything about medical condition to her husband before marriage and after marriage because it is not severe. After marriage she was under treatment and her husband came to know and on basis of that he filed a case of divorce. They stayed together for 12 months and one day some argument took place so my father suggested my sister to come and stay together with us for 2-3 days so that things will settle down.Later her husband kept delaying to stay together and immediately filed a case.My sister has not filed any case because she is accepting her mistake in front of him but not publicly or in written statement and at the same time she is not interested in separation. We have not filed any case but just trying to defend this case of divorce through written statement/smart story suggested by our lawyer and say.Now the case is at the stage of interim injunction and order is pending.
1)According to my sister we have not filed interim maintenance case because my sister is well educated and getting rs.32000 monthly salary and therefore she is not eligible for maintenance and it will be rejected which I totally disagree because my sister is staying at my fathers place which is on rent and my sisters husband is having his own property on loan and a handsome salary of 65000 monthly. We are aware that contested divorce takes lot of time and we are prepared to some extent as I am worried for my sister as I am living in a different city.Is this the right time to file for maintenance? How much maintenance she can expect? Is there any chance of permanent alimony on our side.
Thank you in advance

Dear Experts,
A Village Panchayat President in Tamil Nadu is constructing a public road on govt.water catching lands and willfully deviated the road over my Patta land, in spite of my several oral (telephonic) & written objections (thru' Regd. post with A/D).
The Panchayat President is being instigated by some villagers, lead by an ex-Councillor of that village, who is encouraged by my adjacent landowner- having vested interest in my property, as he was unsuccessful in buying it.
The said Public Tar road is being laid to connect a make-shift temple, which was raised by some miscreant villagers on the embankment of a Govt.Pond.
This makeshift temple is located 0.8 km away from the village and surrounded by agricultural lands on 3 sides and Govt.land on 1 side. Still there is a possibility to put the said Tar road, to the make-shift temple without intruding into my Patta land.
The Panchayat President has taken up the work to on the said Public Tar road (along with other roads in their Panchayat Limits) under Tamil Nadu Village Habitation Improvement Scheme (THAI).
Interestingly the Father of the Panchayat President was somehow awarded the work contract for laying all the roads under the Panchayat limits.
Under these circumstances:
1.Can the Village Panchayat President be prosecuted for inturding/encroaching into the private patta land ?
2. If yes whether prior permission is required from the inspector of Panchayats (District Collector) before filing a private complaint/case?
3. How to get rid of the road and the damages caused by laying a Tar road over my Patta Land?
Please guide me with your expert opinions/advise.
Thanks and Regards.

Hello Experts,
I have a specific query on home loan repayment after marriage and need your advise.
Query below :
My wife (I am yet to marry her) has a home loan of 13 lac on her name. Right now she is paying the EMI of 10k every month as she is working now.
Her father( who is retired) says, he will pay the EMI if she quits job after marriage.
My question is,
1. In a situation when wife quits job and after her father's death , is the husband legally bound to to make EMI payment for the loan taken by Wife before marriage ?
2. Who is responsible in to make EMI payment if wife and her father both fails to make EMI payment ? What would Bank do in such case ? Can the bank legally ask husband to make payment ?
3. After marriage, she would change her surname to husband's surname. Will the change in name create any issues with respect to EMI payment ?
Cheers !

Dear Sir,
My neighbour constructed a small portion of wall on my compound wall.A/C roofsheet is resting on the wall he constructed. I spoke to him in person regarding this. He said that he would bring the Xerox copy of his documents but never turned up. I then wrote a letter to the local Police station CI about this issue in which I made a mention to my neighbour through the letter to secure his construction so that I can dismantle the age old compound wall and construct a new compound wall.
This is the present situation and I request you to kindly advice me how to proceed. I have all the necessary document evidences.
Thank you,
