Dv 2005 will affect or not ?

wife can file dv Act 2005 on husband though they are leaving separately since 16 months ( Both leave in different city )(in this 16 month she filled 498a only )

And i heard that if wife leave seprately more then year then she cant file Dv on husband ?

Is that true ?

What are the provisions in this ??

Please experts need your guideline .

Military) what laws or restrictions would I be subjected to as a NON Indian citizen etc. on land purchases / size etcc...???? #2.) Are property (farm) leases available ??? #3.) Are partnerships ( like sharecropping) legal in agriculture in (Kerala) India ??? #4.) Would it be appropriate to form a : LLC , LLP , PPL , Proprietorship or NONE of the above ??? Contempt of court

During criminal court proceedings the court due to many adjournments, imposed cost on applicant and directed to pay to o.p. but applicant not paid the same. Next time his application also dismissed. How to recover the cost . Whether applicant or his counsel to pay the cost. To whom and how we should demand the cost.

Malpractice in degree exam

i was expelled from exam in final year degree(2011) and i continued my remaining exams of that semester and university not considered my performance of that particular subject and there is no mention of that subject in marks sheet. now my problem is i'm selected for ssc cgl interview and in the attestation form "Have you ever been debarred from any Examination or restricted by any University or any other educational authority / institution ?" what should i answer here? if yes , can i get the appointment letter or not.

Non payment of salary during notice period


My husband has been working for a Marketing Agency (Digital Marketing Software, registered under the Companies Act) in Bangalore for the last 5.5 years.

He recently got a very good offer from a much larger MNC and decided to take it up.

His notice period as per the present company is 2 months and there is the option of buying out the notice period by paying for the shortfall in notice.

He is one of the best employees in his current organisation and responsible for ensuring that many of their clients are still with this business. He has a team of people who report to him.

He spoke with his manager (he reports to the CEO) that he will be leaving the organisation and requested that he be relieved by March 31 2016. In order to cover for the shortfall in the notice period, he offered to work over weekends and ensure that proper hand-offs and hiring happen during this time. He has also offered to pay in lieu of the 21 days of notice period shortfall (his new company is ok to buy-out his shortfall).

On Feb 22, he sent an official resignation to the company, clearly stating that he wants to move on very amicably, etc and stating that his last working day would be March 31 2016 as well as detailing how he would be ensuring a smooth transition so that in his absence business does not suffer.

He has not yet received any response in writing (acceptance/rejection) of his resignation. However, his February salary has been stopped by the company stating that salary is withheld during notice period and will be paid with full and final settlement.

No communication formally informing him of the exit policies was shared with my husband after he resigned.

1. Is it legal for the company to withhold salary for employees who have resigned?

2. If the company is not willing to pay him for services already rendered in February wherein my husband has worked to the best of his abilities and provided services without any leaves etc. in Feb, even when my husband has tendered his resignation, does that not mean that the company has violated the terms of the original offer?

3. Since no acceptance of resignation has come from the company yet, what recourse can be taken/what are the options available if the company not paying salary is a breach of contract terms?

My husband is eligible for gratuity and the notice period shortfall can easily be recovered from the March salary, if needed. As it stands, there is no reason that the company should withhold his Feb salary.

He has been verbally told that holding 2 months salary for exiting employees is company policy even though this was not notified anywhere.

He has put in a formal request on e-mail requesting for all exit policies to be provided to him, but not received any response till date.

Appreciate your advice.

All Respected Sir,

My query is that if a person how doing a private job in MNC Company can pursing LLB as per my knowledge regular course wants attendance. please solve my query.
It is come to my knowledge that some employee are doing LLB regular from several college/Institute affiliated from C.C.S.University and Bar council of India.
I want to challenge their degree.
Please provide me any notification regarding this.

Esic act applicability

Dear Sir

We have 250 employees on payroll of the company. All are getting above 15000/- salary in a month. We are register with Shop \7 Establishment act. Is it necessary to Register with ESIC Authority

Suit files by bank in drt against me

Hi everyone, I booked a flat in ghaziabad in 2011 with promise of possession in 2013, but I did not received possession in 2013. After sometime I came to know that builder has sold same flat to another buyer too. Builder has sold other flats also of same project to another buyers. I became very tense and stopped bank EMI. I was in thought that bank would pressurized builder to do registry in my name because I stopped payment due to non-receipt of possession. But bank sent me legal notice, which I ignored and finally bank put my case in DRT.
This was tri-party agreement. Kindly suggest what should I do now.

Exchange of flats

I want to exchange my flat having carpet area of 540 Sq. ft. with another existing member having carpet area of 386 sq. ft..
Building is under re-development and construction work has already started.
Builder is asking for charges/fees/compensation for this transaction @250/sq. ft from both the members for issuing NOC to us.
Can builder ask for such kind of charges?
is it legally valid and tenable in law?
Please advice.

Whether to file one fir or two

I have to file a complaint against person
for dispute and voilence
but after dispute the person has gone to
different state


do i have to

1) file FIR in city ( state) the where I
live and dispute happened

2) file FIR in city ( state) the accussed
person lives

OR

3) file FIR in the both states


Please suggest how to file police complaint against accused in this situation.
