My Father is in CISF and currently posted in east region. He is now suspended, the reason is that on 05-Mar-2016 , there is 16 hrs shifts (8hrs shift in Morning & 8hrs in night shift ). As my mother is suffering from fever and she is in pain. My Father has done the morning shift but unable to go in night shift ,
He informed to duty incharge in morning that , he is unable to come in night shift and mention the same.
But he got his suspension letter on 07-Mar-2016, for not coming in night shift on 5th of march, under subrule-1 of rule 33 (2001).
Sir, Is this valid reason for suspension ? Is 16 hrs duty is fair?
They even not give a single day rest, Is rest is allotted by govt. to thei employees or not? or they have to do duty all 7 days without any rest??
please provide me information regarding this, I should be most grateful.

Hi Sir,
I really need your valuable advice on 498a case.
My wife filed a 498a, DVC and Crpc case against me, all before to these case i have filed a divorce case.
When running all these,out of the court we settled the matter and on 12thDec2015 in mega lok adalot closed the DVC, Crpc (i have given the said amount in the form of DD infront of Judge) and Divorce also issued in other court where i filed for the same.
On 12thDec2015 one of my cousin listed in 498a was not in india and due to that it (498a case) was not closed. On 12thMar2016 both parties and all the members in 498a present in lokadalot to close the case but PP rejected to sign on the documents required and asked to continue in the regular vayidas.
Now both parties are ready to close the case and all members in 498a are available, please suggest me how to close the case at the earliest as my cousin again want to go to abroad.

Sir/Madam,
My father gave education to my younger brother up to 11th standard and after expire of my father I had given education up to 15th standard (I, e Degree) with technical qualification of shorthand and typing and after completion of education I had kept my brother in job in private company. I used to take case as my son, by his hardworking he had become manager in the organization.
10 years back he was died on road accident while going in car with his friends, case was filed in court against car owner and on insurance company, four years back, court delivered the compensation of Rs.30,00,000/- to my mother, he is unmarried & we are four brothers,
In thirty lakhs only five lakhs are given as cash and remaining amount was kept as fixed deposit in nationalized bank for three years.
My mother promised me that she will give me 50% of fixed deposit amount after maturity, because of taking care of my younger brother.
Now she is refusing to give 50% amount because of my elder brother’s threat & pressure.
Now my earnings are very less and I had two unmarried daughters, my health is also not good, passing through difficult time.
In these regard, please guide me who to get 50% share amount in the court of law, for which I am thankful to you.

Respected Sirs, A development with regards to my friend query on ancestor property rights of his wife.
Now, my friend's spouse's step mother has given an ultimatum to vacate the premises in B.Lore where my friend’s family is staying. To be specific, my friend is acting as a care taker of his F-in-L property in B.Lore as his in-laws stay in Mysore.
His F-in-L has ancestor property in Mysore. Due to pressure from his wife (3rd wife), he has completely transferred the ancestor property to his wife (who is a step mother of my friend's wife). He has registered the property in his wife name without consulting his only daughter.
After ultimatum to vacate, my friend had requested his in-laws to give permission to stay in B.Lore property till 2018 due to his daughter education. However, both especially his Step M-in-L has rejected the request upfront and asked them to vacate immediately.
They also came to know that, the step mother is behaving cruelly and harassing her Father in not allowing his daughter to stay in his self-acquired property of B.Lore. Now they have decided to vacate the premises during April/May 2016 post his daughter's exams
My friend is now exploring the possibility to sue his F-in-Law or to make him to understand that what he has done with his ancestor property is not legal. Because, he has transferred his ancestor property without consent of his real daughter nor giving a share in his ancestor property.
His questions are:
1. Can his wife sue her Father for not providing a share in ancestor property?
2. Can she sue on the ground of STEP MOTHER Treatment? And not doing justice for his daughter
3. Can she sue her STEP MOTHER for disturbing the love and affection between her and her Father. However, no evidences available to prove this.
4. Are there any other grounds to sue her Father and STEP MOTHER Kindly help. Thanks a ton in advance. Shashidhar A

Law- Sec 68(2)(c) of Co Act 2013 -Provided that nothing contained in this clause shall apply to a case where the buy-back is twenty-five per cent. or less of the aggregate of paid-up capital and free reserves of the company: Provided that in respect of the buy-back of equity shares in any financial year, reference to twenty-five per cent. in this clause shall be construed with respect to its total paid-up equity capital in that financial year;
2) It appears from last sentence as if buy back happens for preference share also, is it?

Dear Sir,
I am an NRE and have issued a POA to my Father in Law who is going to sign an initial sale agreement as I cannot travel to India now. I have already send the POA attested by the Indian consulate. But the buyer is insisting to Adjudicate the POA to make it valid. As this POA is only for the initial sale agreement to get an advance amount from the buyer and the buyer will use this agreement to avail the loan from the bank. Kindly advise if the POA need to be Adjudicate or can this be done by the notary to make it valid. We look forward to hear from you soon. Regards/ Shankar

Wats app fake letter shared unknowingly

I need your valuable advice of the following matter regarding watsapp share.
There is a website www.rxpg.com for millions of doctors around the country. In above website there was a letter getting shared by someone and the letter summary was (director of health has requested national board of accreditation delhi to take action against some private hospital after receiving complaints from some students studying there) and when i saw this letter i shared it on doctors group on watsapp and by sharing it reached to the concerned hospital owners and then they confirmed with director of health that this letter is fake and he has not issued any such letter to NBE) and after confirmation they filed FIR againt this fake letter being circulated saying that it affects our image in society.
i want to know legal consequences as i shared this fake letter unknowingly from one site to watsapp which was found to be fake later than i also posted in the same group that letter is fake dont share it to any one. Now i am thinking that can police frame charge against me or the actual person who createf this fake letter and posted it on rxpg.com is only accused as know body knew that this letter was fake and everyone shared it to help other doctors.
Please through some light regarding it act and above matter.
