10 issues were framed by the trial court judge and while giving the judgement, he gave findings on 9 issues only. The judge also made an additional (new) issue and it's finding in the judgement. Under which law of CPC (or any other law), does this judgment become invalid, or has to be remanded back to trial court for re trial for the case.

From Land lord benefit point of view. Whether Lease Agreement is better compared to normal rent agreement/deed.

Which is the best and most reliable mode of agreement while giving house on rent. Is Lease agreement for renting a house more safe than normal agreement.What is beneficial and how for the Landlord.

Dear Experts, Monetary award was given by High court ordered Arbitrator against an Unlisted PLC. We had to move HC because the debtor was not coming forward to arbitrate. Now,just a day before we could file for Execution,they filed AOP in District Court under section 34 to set aside the award on various hollow grounds. They also sought separately a Stay on Execution of the award till disposal of the AOP. The Stay was granted by the court with out hearing us. We are responding with a Counter to vacate the Stay and would also argue against the AOP. Relevant dates of the case:
Arbitration started: 05 July 2015.
Date of Award: 26 Oct 2015.
Date of AOP & Stay petition:25 Apr 2016.
Any relation with new amendments to 1996 Act ?
Can we seek any interim reliefs like forcing the company to deposit a part of money in court? If yes at what stage ?
We are also concerned that the Company may try to prolong the Case and meanwhile encumber their assets in advance to defeat the execution process.Can we seek any remedy for this concern ?

In an appointment letter ,
1.Your employment is terminate either side, by giving one month notice. In the event of your resignation , the company may at its discretion , relieve you prior to completion of stipulated notice period , without any pay.
2.No paid leaves shall be applicable during probation period . Salary for leave period will be deducted during this period. Paid leaves of 21 days per annum shall be eligible after 240 working days.
3.Appointed as a Finance manager. In the event of company absorbing you as manager , your probation period will be six months , subject to satisfactory performance , you will be provided with a confirmatory letter.
Point no. 1 Resignation after 66 days . i.e in Probation period -Without giving notice period . Salary is pending for 20 days with employer.
Point no. 2 Resignation given as employer is not providing salary payment as decided ( deducted for 2 days in the first month itself) , which was intimated to the employer. Also holding voucher payments. Also, employer was not providing the software training which is required for performing to Do the Job even after consistent reminders.
Point no. 3 Resignation , without serving a notice period. Mobile sim provided by the company, courier to the company after resignation and intimated .
Point no. 4 After providing the resignation there is no reply from the employer during the notice period for resignation nor any call recd. Only employer is mailing payslips for the two months to the employee during notice period.
Point No. 5- Appointed and Office in Maharashtra.
Point no. 6: Appointed as a finance manager and provided slip as a Accounts manager .
Question 1. Can employee has to serve a one month notice? or employer can ask him to pay balance 10 days notice pay.(30-20 already serve before resignation)
Question 2 . After providing the resignation, no reply from the employer, regarding any job pending nor for any handover of work, can any action lateron can be taken by employer in future .
Question 3. As employee is on probation, can notice period is applicable when less than 3 month he has work.
we have 6 acres land in Maharashtra which bought by my father before 40 years. We are 3 brothers (including me) and 2 sisters.My father died before 10 years ago.
My sister want their share in agriculture land .Does they have rights to get shares in agriculture property as per Sunni Muslim law?

Hi everyone,
I along with my 3 friends have been arrested by railway police under section 151/116/107 of IPC and got bailed from court the same day.I have been asked to appear in front of the court on 23rd May, 2016.We all have started our career and are working in Private sector companies.I have certain queries regarding these charges like:
1. What are the consequences of these charges. Will it effect our career or job?
2. For how long we have to appear in front of the court. As I came to know by someone that I need to appear in court for like next 6 months?
3. What are the documents or papers we need to submit in lieu of the bail. Do we also need someone(s) as a witness?
4. What proof do we will get from the court regarding our bail?
Kindly sort of help/ advice/ suggestion will be highly appreciated and I would be very thankful to the legal members of this club.

Sub sec d of sec 2 of Employees Compensation Act,1923 states who are the dependants of the deceased employee.Under clause (iii),certain category of persons are stated as dependants.My doubt is as under.In a given case where the woman employee died left no child and husband also predeceased.The parents of the husband/brothers and sisters of deceased husband are no more. The Tahsildar has given a II class legal heir certificate in favour of sons/daughters of brother of the deceased women where the brother of deceased woman already expired. Further, the deceased woman employee was living with the son of the deceased brother of her during the time when the accident occurred Whether as per the definition of dependants in Sub sec d of sec 2 of Employees Compensation Act,1923, the legal heirs can be considered as dependants of the deceased woman employee. If so the relevant decision/amendment may be furnished

Hi Team,
This is in regard to seek help, recently I visited to my family in Pune, from my wife bedroom there was cigarette packet. She is staying with her mother and kid. I was not having job since 5 months. I was for searching job Bangalore Hyderabad. Now I am in Mumbai. Every expences she forced me to bear during the tenure though she was working with 34,000/- PM. From last week 4 week I am unable to express or seek help or how to act on unacceptable thing which caught in home. I asked also the kid , is anyone came in home. He said no. If she is smoking how and what to question. I am unable to accept these unsocial behaviour
