discrimination in transfer

I am working in Indian Audit and Account Department (Central Government Department). My wife is working with State Government . Dopt provide for transfer in such cases where spouse works in State Government to same station. However as IAAD has banned unilateral transfer only deputation are given in such cases.And a office circular has been issued in our office that such deputation will be considered after confirmation. So my deputation was blocked on this ground. However 5 employees who were even in probation were given deputation in violation of rules. My question is whether i can sue officials for caste based discrimination , since I belong to SC community and my social background is likely to be reason while in similar situation 5 employee were deputed. I have already complained to office regarding this. What exactly is the procedure to file the case. I am aware that court will not interfere with administrative process i.e. transfers/deputation . My query is whether or not a water tight case of discrimination can be made out of this. Further since violations of rule take place there was likelihood of favoritism, can this be clubbed with case of discrimination.Please enlighten me regarding this issue.

GPA cum Sell Agreement

Dear Sir,

Is it legal to buy a non agri plot from registered GPA cum sell agreement holder in telangana region?

Since Supreme court in 2011 considered this deed invalid in one of its judgement. What will be the consequences if we enter into the deal with this type of GPA holders?

What precautions and due diligence should be perform?

After buying what if GPA being revoke by principal party?

Appreciate if you could shed some light on this subject.

Sec. 80-d of income tax

in a co. for the group mediclaim policy for the employee and their family the annual premium is paid by the employer.

The policy is on sharing basis, where by the premium is paid on 50 -50 basis by the employer and the concerned employees.

The employees’ contribution (50%) are deducted from their salary.

The queries are :
1. Whether the individual employee shall claim deduction u/s 80D for the 50% or part of premium paid by it, during the FY.

2.Whether the premium paid by the employer (50% or part) amounts to perquisites ?– taxable in the hands of the employee?

Farmer certificate

Hello Sir,
My father was a farmer in uttarakhand and was working as an employee in TOI in ahmedabad for fify years. I am married and we are staying in ahmedabad since 50 yrs. But my husband isnt a farmer nor his father. So can i purchase an agriculture land since my father was carrying a farmer certificate ??
And if i cant then whats the procedure of getting an agriculture land without carrying a farmer certificate. ??

Can we produce evidence on completion of first party cross

My friend Ravi is facing Police Case( "498A & 3/4" ) since 8 Years and other two cases in Bhopal. He had filed divorce case (on " 13 a "etc) in 2013 in Bhopal. Because, his wife is working in Pune she got transferred the case in Pune by SC. I have few queries as follows.

1. First Question: - In Divorce Case, Petitioner side all cross examination is completed. Now Respondent as 1st person Cross is yet to start. In this stage Petitioner is showing few new evidence like Greeting Card, Photos.... etc. related to happy moments. Respondent is objecting the Pray & They said that this is not a stage to put any evidence because Petitioner Cross is completed. He cannot ask question to Petitioner. So pay for new evidence should reject.
Kindly Suggest on what ground of Law Petitioner can submit the Evidence.

2. My Second Question is :- In FIR case of 498 A, Investigating Officer Cross Examination is completed in Trail court. We are trying to get certified copy of Case Dairy of Investigating Officer (Police Sub Inspector) OR at least Victim Girl Statement but Layer is telling it is not legal to get Certified Copy or any document submitted by Investigating Officer.
Kindly Suggest on the ground we may get the copy?

Eviction

One eviction case is at Tamil nadu munsiff court to evict a tenant from my friends building.if he succeed the case,can he evict the tenant soon?
Should he wait more proceedings?is there any chance to tenant bring legal objection? should he try caviout filing?will tenant bring stay?can he get a direction from high Court for total solution to avoid delay in eviction.because petitioner need quick eviction of tenant from his building

Taxation of trust

Hi, Hoping to find a piece of advice from you. My query is- An educational society registered under The Society's act has gross receipts for AY 2014-15 as rs.128 lakhs and the amount applied for capital and revenue expenditure is Rs.135 lakhs. The trust does not have registration u/s 12A and nor does it have approval u/s 10(23C) also the ITR 7 was filed under Income from other sources for claiming exemption u/s 11 of the Income Tax Act,1961.Now CPC has issued an order for taxing Gross receipts of Rs.128lakhs ignoring amount applied. Please advise if CPC is correct? if yes, how? and how should this be dealt with?

Rent case

Dear Sir.
My friend has a case in Tamil nadu to get back his house from tenant.now it is final stage.one case isEP RCOP (EA pending) and other is RCOP (part heard)).if court decision favour to him,can he evacuate tenant without further proceedings .if tenant go for appeal,case will go long time.how can detain the tenant from such actions?if my friend file caviout in upper court,can he do evacuation quickly.can he get a direction from high Court to avoid any objection to evacuation.bacause he has to get his house as vacant within 1 month

Guidance

1. Booked a flat in 2009, have made complete payment inclusive of stamp duty and registration.
2. After making complete payment and on inspection of the flat, found that the amenities provided was not as per Agreement.
3. Requested builder several times to give possession of the flat with amenities verbally and through registered A/D letters.
4. A letter sent to residential address has been accepted , but there is no response.
5. In 2011 engaged a lawyer who upon hearing my case said he would be filing a case in the Consumer Court. Initially he kept on sending notices to the builder by registered A/D, at the office address which had no result.
6. On various follow ups I asked the lawyer to send the notice at the residential address which he did not do so, neither bothered to follow up where the notices were going ? According to my lawyer it is mandatory that notices should be sent at the address mentioned in the Agreement.
7. He collected the fees for filing the case in the consumer court but never updated me. He would avoid my calls and keep changing his cell number. When asked for consumer case no. He would give some reasons and told me that I would be getting an exparte order.
8. During this time my husband was bedridden with paralysis and I could not devote much time on commuting and trusted on the lawyer.
9. The death of my husband in 2013 was a great blow to me and self was not aware of how to cope up with these problems. Was staying on rent as I was not given possession of my flat.
10. In end 2015 I came to know that the builder was trying to dispose my flat.
11. I contacted the lawyer immediately who drafted a criminal complaint letter to the Police
Station and asked me to go personally and file the complaint at the police station. The lawyer did not come with me. I was at the station till late 9 pm.
12. The police did not accept the complaint as the complaint sounded like a civil matter. Of course the police asked the builder to come to the Police station who came once in my absence. My lawyer did not come to meet me or apprised me. All that he was saying was false.
13. By then I knew he cheated me. I asked him to give me his bar council number and refund my fees which he has not done so far. I have the lawyer's contact no. and email I'd. I don't have his new office/residential address.
14. The lawyer has not provided the required information but says he has no objection in me filing a complaint against him in the Bar Council.
15. Meanwhile, I have engaged another lawyer who has sent a notice to the builder's residential address which has no response.
16. With no response from the builder the lawyer has submitted a criminal application which has been accepted at the police station. It's almost a month and the lawyer has not received any communication from the police station.

17. I am now more afraid of lawyers.I need your valuable advise based on my above history which has been given in a nutshell.
