In 1972, my Father through a Deed of Settlement which was registered in the office of Sub Register at West Bengal, transferred his property to my Mother. It was stated that if any sons does Love Marriage or misbehaves or causes disturbance in the family, in that case my Mother can deprive them from the share of the property. Father died in 1978.2 sons did love marraige and one of them died later. Mother made a Deed of Gift in favor of 4 sons in 1987, and excluded 6 other children as they did not take care of her. Subsequently in 1999, the 4 sons made Mutual Partition amongst themselves and the same was registered.I am one of the beneficiary.Out of 4 brothers who accepted the Gift, 1 brother made a Gift deed in my favor in 1999. He requested me for financial help and over a period of time, i gave him Rs.150000/- in 3 instalments by Bank Drafts The same Gift Deed was registered in my name and mutation was done.In 2008, another brother made Gift Deed in my favor which was registered but at the time of mutation, it was discovered that the holding no of the property was wrongly mentioned and a fresh Gift Deed was made in Jan 2015, which was registered, mutation was done and Land Revenue Dept confirmed the property in my name. This 2nd brother who made the Gift deed originally in 2008 was unemployed and he also asked for financial help. For the next 4 years, i gave him a total amount of Rs.809900/-and I also allowed him to stay in the same flat Whenever he needed medical care I used to provide him.Now after 44 years, one of my elder brother who was not given any share in the property, has filed a Suit against me and other 3 brothers under Section 151 of the Code of Civil Procedure u/o 39 r ! & 2.
My question is can someone challenge my Late Father's Deed of Settlement of 1972 after 44 years ? Can someone challenge my Late Mother's Gift Deed of 1987 after 29 years ? Can my 2 brothers who gifted their share and who were given some financial help by me , can claim that they sold the property to me and it was not Gift Deed ? All the individual share of my property has been registered and mutation done, Parcha done, can any one challenge it and can a court revoke the same ?
The 1 st hearing is on 27.06.2016 in Kolkata and my lawyer will represent me, as i am in Pune.

My cousin's wife is living separately since she gone for delivery. Earlier she used to give her daughter but for almost 2 years she refused to give. My cousin waited for her school admission and after admission, managed to get it directly from the school and was dropping back to her wife's home in the evening twice a week. He managed this for almost 1 year. [ Prior to picking daughter he was also informing his wife.]
Few days back wife refused school management to give him their daughter. School management held joint meeting and informed both to have some amicable solution. So ultimately his wife agreed to give her for twice a week.
Just after a week suddenly she gave a notice to the school not to handover the daughter to husband without court order.
Now the questions are :
1) Is the onus of getting the court order is on Husband ? If not, what he can do here ?
2) Suppose he goes to court how long is the procedure to restore the original status of getting daughter 2 days a week ?
[ Daughter is just of 4 years and husband is returning her back to her mother when she returns from the office.]
3) Is there any way by which she can be forced to maintain the agreed terms in presence of school management ? [ Like police intervention to maintain law and order till court issues final order]
Hi,
I am male, who was married (love marriage) during July 2009. After some months, we separated and got divorce on November 2011. Again I got married to some other girl during April 2012 (arranged). Though she knew that I was married before, we did not inform about the same to their parents. Now after 4 years of marriage, due to some misunderstanding between my wife, she is threatening me that she will give complaint that I hid my first marriage to her family.
(My first wife has also remarried another guy during december 2011.)
Am i going to suffer on bigamy or adultery laws?
In this scenario can my wife(second) get divorce from me?
I have a male child with my second wife (3 years old). Will it effect on my custody request.
(My first marriage was done according to Hindu Marriage Act and my second one is according to Special Marriage act)

Need some help in understanding the law related to property registration and membership transfer.
1. Our society got registered in 2010 and subsequently the society was handed over via 1st AGM in 2010 itself by the builder.
2. As per the handover record, we got the registration details and list of members registered from the builder (Statements A, C, D etc.)
3. From the 200 flats constructed, 9 were declared unsold by the builder. It was mentioned as unsold in the statement A records too.
4. There are few records where the flat owners name is mentioned, but the builder did not provide the sale papers or index-2 of those flats.
5. Those few flats were sold to the people whose name was mentioned in the transfer records in the year 2011. i.e. one year after the society transfer.
6. The index-2 documents mention that the transaction was directly from the builder to the mentioned owner, hence they claim that society transfer fee is not applicable even though the flat was sold after the society formation.
Q1 - If the sale of a flat is the first sale from builder to flat owner, but the sale happens after society formation, can the society ask for society transfer charges
Q2 - If the sale agreement of a flat happens after society registration and transfer, can the builder put the prospective flat owners name in the society membership records in advance?
Q3 - What legal recourse can the society take against the incorrect registration records provided by the builder?

If I mortgage a non agricultural land for borrowing a loan for agriculture purpose and incase of default, can SARFAESI be enforced on that land.
Dear sir/madam, I am sivakumar from Karur. We have an agricultural Land at our Village. The distance between our land to main road is 50 meters. That distance is connected by the path and that path having 50 meters length and 3 meters width. This path is commonly used for 3 persons including me. But, legally reserved only for other 2 persons except me. Because, we used that path by the verbal agreement.
In the same time we have use that path is more than 3 generations. But, Now that persons block the path and tell “ you have no rights to use the path”. So sad, we have no other path to reach our land.
