Service tax

I live in a township where there are about 1500 flats. The builder has taken supply from state electricity board at higher voltage and has installed their own sub meters in the flats. Based on consumption they are billing us at tariff of the electricity board and charging service tax on the bill. Is service tax payable in this case.

Daughters right in Father property

We have our fathers property in Moradabad, UP who demised 3 years back and did not leave a will. We are two sisters and a brother and all are married. We would like to know if the sisters have equal right in the property and can our brother forge a fake will and sell the property or mortagage it? He is going through financial issues and we suspect he would do that without our convent.
Also how can we legally stop him from doing the same?
We would like to register the property in the name of all 3 of us and need advice.
Can we send an online notice or registered notice from other state as both of us the sisters don't live in Moradabad.

Consumer protection

HELLO ,I bought a new Innova Crysta 1 month back ,but after about 1000 km of running three tyres got damaged one by one in a span of 1 week.The tyre is of Bridgestone make.I complained to Toyota dealer and asked for free replacement .They told me to wait for sometime but now they are saying that they can compensate only 75% of the total cost because they r saying that it is not manufacturing fault of tyres but i am not satisfied as it is a clear case of defect of tyres Pls help me ,regarding the legal options available ...Thank You...

Buying land from SC guidelines

Hi,
I would like to buy a land in UP from an SC farmer who's willing to sell it to me at market rates.

I understand that the Dalit land amendment bill was passed and approved by the governer in Dec 2015.

Application under section 340 in a decided case

We want to submit an application under section 340 Cr. P.C. against the accused for a case which was decided on 12.07.2016. Since during the judgement, the accused had stated another lie to have less punishment that he is an old aged man suffering from heart cancer even though he was a 40 year old man who has no such disease.

So can we file an application under section 340 Cr. P.C. even after the final order in the case against the accused for false statements made by the accused during the trial of the case and during the judgment in the case?

Violation of Natural Justice

Disciplinary Authority has initiated Disciplinary Inquiry and appointed Inquiry Officer. During the inquiry said Inquiry Officer has rejected to accept some relevant Defence document to defend the case. An application has been made to disciplinary Authority as well as applet Authority to terminate the said Inquiry Officer being BIAS minded. But all these authorities has rejected the application. Whether the Petition may be filed in High Court as violation of Natural Justice

Abatment of suit.

Sir,
I filed a special Civil Suit at for cancellation of registered sale deed.

There were three plaintiff out of one was expire in the december 2015 and the same thing is declared in the court.

Plaintiff no. 2 and 3 were son and daughter of the plaintiff no. 1 still there is one more son who is not party in the suit.
the suit was abated due to non joining of the parties on 5th July 2016
what can i do for restoration of the suit?
Weather i file delay dondone application or challange that order in High Court?
or File application under Order 22 rule 3
Pls suggest me and guide me.

Non-payment of full & final dues on retirement

I got retirement from Desein Private Limited after servicing the Company for more than 33 years, at the age of 70 years, on a senior position as 'Vice President' in June 2015. Company has transferred my services in the past, to sister concern "M/S OPG" probably in 1999 and again back to Desein, probably in 2001, without taking my consent, for Company's benefit, probably on taxation. The original Desein appointment letter served in 1982, does not have clause of any transfer. It has a clause of gratuity on retirement. The Company is not paying me full gratuity, treating transfers at new appointment. I could learn that if a Company transfers the service of an employee to its sister Company, all previously earned benefits in transferor Company, are also transferred to transferee company and there is no break of service. I could know that this has happened at the time of transfer in this case also.
It may also be known that Director - HR is an under-matric and has no knowledge of law at all. He is manipulating rules to his benefit, to probably drawing highest salary in the Company and retail his job. I have sent many letters to the President and Executive Vice President of Desein, but to no effect. They are not even responding to my phone calls. They are avoiding any contact with me to respond to my legitimate claims, submitted in writing, since July 2015.
Please guide me what are options available to me to recover my legitimate dues.
