How can a charitable trust acquire land from a goverment authority? The charitable trust is a temple in mumbai for constructing another temple.

Recovery under section 101 in housing society

Respected sir/madam. 1) One of our member in society defaulter as per committee. 2) society file a case under section 101 in 2006 in 2010 the member given the cheque of outstanding amount with interest but without penalty . 3) property tax penalty is levied on only this member but committee never passed in resolution. 4) society never clear the cheque, now society want to file a case again under section 101. What is the chances of recovery under section 101 for society also time limit is also for recovery under section 101 if yes please describe the period.? Query is urgent please reply as earlier as possible.

Is correspondence llb eligible for practice.

Dear members, My wife is interested to pursue LLB/ LLM and she stays with me. i have been temporarily posted, for 1-2 years, at a place other than base location.i do not want to waste time, to wait until end of my temporary posting.

Is there any way to pursue LLB online/ correspondence in India and if yes then is that course recognised to practice as Lawyer in Madhya Pradesh?

Please suggest.

Is victim just a mute spectator in state cases?

On my police complaint on 3 persons, a case was registered by police over 2 years back.

Accused have taken bail and although one of condition of the bail is to remain present, most of the time they don't appear. The public prosecutor is also not taking any objections or sufficient interest in the case (in fact 3 PPs have been changed in last two years).

When I requested court to look into this, court ask me not to speak in this matter as this the state case. Court even asked me that you are not required to be in court.

Is it fair? I am the victim and I can see that accused are abusing the process of law and despite of that I can not object.

What are my options?

Missing/lost my cheque

sir,
I have lost/missing my cheque dt. 22.07.2015 and i have give the application in my bank for cheque missing/lost and bank stop the cheque in my account as reason for "lost of cheque by drawer" but some boddy got this cheque dt. 19.11.2015 & claim Rs. 10 lacs and file the case u/s 138 of NI Act. so sir please help me. but i have no fill the date, amount and name of party in such cheque, only sign the cheque.

Can we transfer, N.I Act case from One state to another State. Due to some Health problem to avoid travelling.

In a situation where after the acknowledgement of Notice issued U/s 138, 45 days(15 plus 30) are lapsed and the complaint is not filed,whether cheque can be lodged second time and issuance of second notice can serve the purpose.

Tut ion classes in cooperative housing society in malad east mumbai is allowed?

We stay in a Cooperative Housing Society in Malad east Mumbai . One of our flat owner who has many flats in our society and using one of his vacant flat given on rent for tuition. Children from outside coming (who are not resident)for tuition and probably Teacher is also outsider.
Can society has right to allow and is permissible by the law?
Can flat owners of same floor can object due to nuisance & disturbance even if society has given permission?

Regarding get divorce and not to pay maintenance.

We belong to Hindu family (both of us). We got married (arranged) 1.25yrs back. But soon after the marriage she started quarrels with me in triffle matters. She accused me that I am having an affair with one of my collogue, which was not at all true, but she insisted that I should admit it or she will comit sucide. She is asking me to get divorce or shr will comit sucide in triffle matters. In other words we can state that she is emotionally blackmailing me right after the marriage.
After councelling with her and my parents she stoped that but keep on taunting me for the same. Then after few months she accused me about potency, which was also not correct. She keep on quarrelling with me and family members in triffle matters. Now a days in small quarrels she started snatching and slapping me also. several times she did that, once she slapped me in front of her parents also, In the month of april we called her parents and told them about her, she also insisted that her daughter is wrong, and she should not do so. A month back, she was suffering from urine infection, I insisted het to have dinner at 11:00 at night so that she could have the medicines, she started hitting his head, i called my mom from her room, my mom asked me call her maternal uncle who resides in the same city, as soon she heard that, she ran to balcony, saying that if we called her uncle, she will comit sucide right now, any way we caught her, called her uncle at late night, and sent her with him. From past a month she is with her parents. Right before sending her to her parents she were insisting me that she is not ready to live with my family, either I should take a seperate accommodation for her, or divorce her or she will comit sucide. I informed this tp her husband, first time to father and second time to her mother, both of them were stating that she is wrong.
I could leave my mom, I love her so much, on the other hand, I am a state govt officer, my brother is unemployed, my father expired 13 yrs ago. How could I leave my mom
Now I want to get rid of her. I consulted some lawyers, That if I file a divorce, is there any remedy to get rid of maintenance, becoz my whole family depends on my salary, i dont have any other source of income.
Kindly suggest me the path.
