Hello all,
I have this issue with selling a property. Guidance value of a property is always less than market value. I always have the problem with this. The buyer doesn't want to register at more than guidance value. Now I will be taking the market price for which he will not be ready to register. I will not take cash. If he gives in cheque or DD also what will show that as. That money cannot be shown as source of income from property if it is not mentioned in the registration document.
If the property is registered at a market price of say Rs. 1 Crore then registration cost will be Rs. 6 lakhs at 6%. Now if the guidance value is say half of that they one would like to register at Rs. 3 lakhs. As a seller I want to sell at market price and register the same at Rs. 1 crore. How to deal with buyer to convince that legally he/she should register at market price is a problem for me. Any solution for this issue will be highly appreciated.
Thank you all in advance for your time help and advice.
Regards,
Pushpa

Hi Experts,
I filed a Cr. Transfer petition a the Hon.SC in MAY 2015 since my wife filed 498a on us in Bangalore and then DV and other cases at her native in Tamil Nadu.
I was happy that at least my petition was not dismissed straight away as it happens with most men against women. But my happiness was short lived as the respondent took 10 months of time pleading the registry to file her reply and finally did not file their reply.
Now it is SEP and the petition became ex-parte in April 2016 but we still do not see any end to our woes, it seems the registry wants to drag the petition as long as possible by postponing the listing or systematically kill the petition to benefit the woman respondent.
Un-knowingly I hired an advocate who is from a place close to the respondent from the same state and I have strong suspicion that they have communicated with each other on how to drag and delay and make the petition useless.
Now the likely listing is at the end of November and I believe this will continue.
Please let me know the options for us to get a quick listing and get the petition disposed off.
Should I write to Hon.CJI on this matter? Please provide your valuable suggestions.

I have got contested divorce from my Ex- husband, custody of the minor son is with me. During cross-examination of my ex-husband he admitted that his father's property is a ancestral property and he will get his share from it in future.
The detail of the property is as follows:-
A lease hold property (house) was purchased by my grand father-in-law in 1960’s at new Delhi. He died in 1982 without leaving any will. My grandfather-in-law left behind two sons & two daughters. In 1992 my father-in-law and his brother applied for conversion of property into freehold after their sisters and mother relinquished their rights. The property was then converted into freehold and Conveyance-Deed was duly registered in their joint names. Now the property stand registered in the joint names of my father-in-law and his brother.
1.Now Can I file partition suit for my minor son's rights in the above said property.
2. Since my husband has admitted the property to be ancestral.
3. I have apprehension that till my child gets major, my ex-inlaws would sell that property.

Respected Lawyers,
I recently had a road accident in Bangalore-Chennai highway in Vellore while I was riding a bike with a pillion rider.
I was hit by a Lorry, head on collision as per the FIR as I don't have any memory of the accident. I and my pillion had serious injuries and fracture and still in recovery phase.
Luckily we are stable after multiple surgeries. FIR is filed in Vellore (pallikonda police station) under section 279 & 338 of MVA. I have no idea about where my bike is, it caught fire as per the spectators. After discussion with my lawyer in Vellore I came to know the Lorry doesn't have insurance & he told that owner doesn't have money to compensate.
I want to file a case in Bangalore. Need your valuable inputs how to proceed in this regard. Should I go to the MACT court please advice.
Thank you so much.
False police complaint
Hello Everyone,
One person has filed a false police complaint against me and my family members u/s 323, 504 and 506 for forcefully entering at his home and threatening. The court has issued us summons to attend the court personally or through a lawyer. On the day mentioned in the complaint I was at a different place and my family too (We have the evidences).
The lawyer with whom i consulted has told me that we will have to attend the proceedings either personally or through lawyer on the day asked for. He told me the exps of bail (Rs.5,000 per person) and lawyer's fees. He also told me that this case may take few months or 2 year to finish off. Please tell me what action i can take in this scenario.
Also let me know whether the Indian law is this much weak that anyone can file an unnecessary false police complaint against the other and compel the other to face court proceedings. I am not getting, why are we required to face such PSYCHOLOGICAL and FINANCIAL punishment?
Isn't there any provision in IPC to stop this type of harassment?
