Mall management by builder

The following issue is about a mall located in Oshiwara, Andheri. The builder has sold off almost 85% of the shops and taken two years of advance maintenance i.e one years advance and 12 post dated cheques. The builder has not paid property taxes right from 2014 for which he has already received money from the owners. Apart from this the central airconditiong does not work in major areas of the mall and the shops in it. Due to non payment to housekeeping and security the condition of the mall is going from bad to worse. Please advice what should be done by we owners to take action against the builder. Can we form a society of the owners and take handover from the builder. Respected members of this group please give your valuable suggestions.

Hello Sir
My Name is Kamlesh C Shah and i reside in Jogeshwari west Mumbai-400 102 Last year in Aug-15. I have booked a flat in Naigaon East from DDPL global infrastructure pvt ltd corporate office address is Unicorn House, Shreeji Vihar Bunglow No.2, Opp. Kandivali Telephone Exchange, S V Road Kandivali (West), Mumbai-400067. but due to family issued I have to cancelled the booking which is been intimated to the company before depositing the into bank and as per his assurance I have not stopped the cheque and they deposited it without informing me now when it comes to returning the amount the builder and his workers are refusing to give 100 percent amount the cheque given to builder was of Rs.103,500.00 and after one and half of struggle and stress the company has refunded my rs 50000 and when I asked about rest of money than they are telling me whatever amount you have received is by luck we don’t refund the amount and when i asked about refunding the pending amount instead of giving assurance they are telling do whatever you want kindly please help me get back my money i belongs to a poor family and 53500 is bigger amount for me.
When I visited his office for the follow up for my payment his bouncer hit me badly and after police complaint they gave me Rs. 50,000.00/- . Again I went to police station for the rest money they are saying we cannt do anything in this matter. You have to go to court. Please advise me what next step I should take to get back my balance amount Rs. 53500.00 /- Looking forward for justice

my grandfather has 3sons and 2daughters,grandfather had 22 acres of land,and had partition deed(registered)in 1970.the first son sold his share,the remaining two sons are in possession of the remaining land,sisters had expired,the heirs of the sisters are claiming share in that property kindly provide,is there any right for sisters heirs in the property,

Mediation settlement

A civil suit was initiated in a district court for recovery of money. Later on the matter was referred to mediation. In the process of mediation the matter was resolved and the settlement was signed by both the parties and the advocates. Later on the statement of Defendant was also recorded in court of law. But no decree was passed by the ADJ. Execution petition was filed and the defendant told the bailiff that he has no money at that moment and he would pay the money later in the court. Now the defendant says that the settlement was coerced. A contempt petition was also filed. Kindly help me with the relevant provisions and judgements by which the money could be recovered by the plaintiff.

Application of section 379 of the companies act,2013

Suppose XYZ Ltd. have a step-down subsidiary (say Company B) outside India, which is wholly owned by their direct subsidiary outside India (say Company A). Company B has recently received RBI approval to set up a branch office in India.
Whether opening of Foreign Company B’s branch office in India will attract compliance under chapter XXII of the CA,2013? The point of contention here is that section 379 narrows the applicability of the chapter to only those Foreign Companies which have Indian equity holding of 50% or more. There is no reference of whether such holding should be “direct” or “indirect”. Therefore, in such a situation, since entire shares of Company B are held by another Foreign Company A, will the provisions of section 379 apply?

Suit decreed

Respected Sirs
i am the Landlord of a property in Ghatkopar Mumbai. I had filed a eviction suit against my Tenant who is a Hospital and it is pvt ltd Co and the handled by two directors. The suit was filed for illegal additions/alterations carried out in the premises without the consent of BMC or myself. The suit was decreed in Aug 2016 and the order was to vacate the premises within one month. However the director asked for stay to the order but it was not allowed and he filed a appeal in appalate court.
Now I want to know the following things. I as the Landlord has won the case so now if the other party files an appeal who will bear my legal cost.I have filed the valuation report of the property at market Rate and the Ltd Co has filed at Ready Recknor Rate then which value would be taken for depositing the money in the court.
The suit was filed on the grounds of addition/alterations in the premises which caused heavy sepage of water in the Ground floor premises. Now after the suit decreed the same cause has started but this time the leakage is more severe compared to last time. All the complaint letter from the Ground floor tenant who is a nati0onalised Bank along with the photographs showing the extent of damage to the property are filed along with my reply. Will the court take note of this and dismiss the appeal.
You are requested to give advice and opinion.

Obtain visa when separated from husband

I have been separated from my husband for over 6 months and in no direct contact since. Have a 3 year old son. I am planning to travel on a vacation out of india along with my parents next year and would require my husband s signature and NOC to process my son s visa. Under no circumstances would my husband co operate if i approach him directly for his signatures.

Is there any other option to get this done from him?
