Heroin smuggling

Ship having 1400 kg heroin then captain n crew members are arrested..crew member s responsible for that smuggling or captain? When crew member will get bail and how?what to do?

Resignation asking

I was working with price sales and marketing company since Feb 2017 , on 26 August while on touring udaipur , I had loose montion and fever a virus atttack , when in Jaipur test conducted found kidneys damaged creatinine was 10.6 , biopsy proved that damaged of kidney due to infection , on 23 Oct when I asked to join they blocked all ID of mine and asked to resign .
What compensation I can ask under indian law ?

Epf allicability on national holiday wages

Sir,

I am Anil Kumar S working as a HR Manager in an organisation . My Question is Is national holiday wage applicable in EPF or not . One of the site I saw an answer the following.

"PF is always calculated on the basic wages and also on the provided D.A (Daily Allowance) & R.A (Retention Allowance) if any, therefore incase any staff fm yours company work on any national/festival holidays then his basic wages are not going to be diffrent what he/she earns in a regular month and you would only pay him double the rate of normal wages for that holiday work done by him and this would be considered as Overtime done by that concerned employee.......therefore no PF would be deducted on this overtime payment, however if that concerned employee is covered under ESI (Employees State Insurance) then you would be required to deduct ESI amount on the overtime payment made to him for the extra work performed on the fastival/national holiday."

Is it true or not . please clarify me . If it is true kindly provide any supporting documents.

Sir I filed ip case in 2012 .I didn't attend any hearings.and the case dismissed in 2014 January.now if I buy any property wil it face any problem. ..??

Seeking legal advice

Respected, Experts,
First of all thank you so much for your helpful advice. Before stating my queries, my present situation in brief -
with the support of the women's commission I lodge an F.I.R and the accused got arrested u/s 341/323/354B/354D IPC and 66A/66E IT Act and he allowed to get bail on the ground of the default of I.O. Please note, after 10 months of his arrest no proper investigation has been taken place. My (as I am the victim) mobile phone has been seized but his mobile phone, computers have not been seized yet and even after my 164 Cr.P.C proceeding no charge sheet has been submitted still yet. No single trial has been taken place. For the purpose of the investigation I informed the V.C of the University with the evidences of the incident as it happened in the campus and we both are student of the same University. But as usual, no investigation and even no single query took place by the authorities of the University. For the negligence of the system the harassment and defamation escalated to the worse. They threatened me to withdraw the case. The I.C of women P.S insulted me that if I am a woman I should commit suicide after the incident whatever happened to me. The Bar Association clearly told me that because the accuse is a well known lawyer and member of BAR they will support him although they know he has committed crime to me so even I got no lawyer for my side. The accuse has strong political support and long handed contacts so he easily got to know about all the evidence and steps I have taken. They simply made me alone and helpless. I am alone fighting against them so please advice me. My queries are that what is the next level to take proper step against these dirty game? May I get help from media, if yes, then how? and if I do not able to afford any unbiased lawyer for my side, what should I do?

Property and family disputes

I am trying to explain the whole scenario of mine through the below-mentioned paragraphs. Requesting you all to provide the appropriate solutions.

• We have in all 2 properties in Maharashtra, 2 plots, a commercial complex, one house in a village and also
few acres of land in the village.

• Both the properties which are in Maharashtra were in the name of my deceased grandfather (Sale deed was
executed in his name) who is no more since last 4 years.

• 2 Plots which is in the village are registered right from the very beginning in the name of my Grandmother.

• The Commercial Complex which is in the village was initially in the name of my grandfather but later on, it was
registered in the name of my Mom and Aunt.

• Village house is not in anyone's name since there is no such process for the village house.

• The farm fields were already registered in the name of all the legal heirs of my Grandfather as per the
procedure of the government, upon post death of my grandfather.

• This is dispute particularly in between my Grand Mother and My Uncle. My Grandma stays along with my
Father.

We wanted to distribute the property which is the name of the deceased amongst all the legal heirs of the Grandfather. His legal heirs include a wife, 2 sons and a daughter.
It is creating a great fuss amongst the family members. We want to get these property issues resolve through court. What are the measures available for us?

Is legal heir certificate and surviving member certificate

My father passed away 10 years ago and my mother has also passed away some time ago. My sister and I were their only children. Neither left a will. My father had a self built property. Can my sister and I get a legal heir certificate in Delhi? Is it the same as a surviving member certificate? Can we jointly apply for the same with the SDM? Will that legally make the property ours jointly?

Compromise cheque bounced

In January a compromis in take place in civil suit but the chque given during compromis has been returned by bank due to insufficient fund. Should i file 138 case or should i file execution of that civil case or both

Cancelling marriage after the engegement

Hello Sir/Madam,

I had the engagement last month and the marriage date & hall has been fixed for 2018. But on our daily conversations, I am being discouraged on her behavior/attitude/adverse reactions like
for eg. the girl not ready to cook (instead asking me to cook), Disrespect to my parents, not ready/laziness to fulfill basic responsibilities like caring my parents, caring myself, caring family & not giving value to relationships/emotions.

Many times I have tried to convince/explain about how the things should be!, but no changes seen :( I am afraid to marry her as her adverse behavior may lead to misunderstandings/ DV issues after marriage..

Kindly advise whats the legal impact to cancel the marriage?? I am ready pay out any expenses

Also I am expecting a strong resistance from girl's side and we don't have any mediator who can help.. will the legal procedures help us?
