Dear Experts,
Recently my wife applied for domicile certificate in local tahsildar office in Mumbai. My wife has not changed her maiden surname to my surname after our marriage, as she intends to keep her maiden name and surname and does not wish to change it.
The officials refused to issue her domicile certificate in her maiden name, as she is married to me. As according to them as per Indian customs, it is mandatory for married women to change her maiden name to married name, which I believe is legally not valid.
In response to their argument, I provided them a bombay highcourt judgment dt. 2nd Nov 2011 in reference to Family Court Rules, in which the court categorically said that "where a wife has not changed her name after marriage by publishing a notice in the Official Gazette, she may continue to mention her maiden name." But obviously, they refuse to accept my argument and denied to issue a certificate in her maiden name.
Kindly guide me in this regards.

In this case all of accuseds are arrested and one child (8 years old) who is also detained with her mother her mother is one of the accuseds . Police reported the child is lapping child. We apply 439 two times but rejected. And apply a petition on behalf grand mother before the C J M for

The court has ordered my husband to pay Rs 10000/per as maintainance for my daughter. But he has refused to pay. So distress warant has been issued against him. But he has no property on his nane which could be seized......So is there anything else which could be seized. Or then what is the next step i could take. Please suggest.

This is for my friend. He was driving when a women walked right in front of the car. She had an injury on her foot minor fracture and a cut. He took her to hospital and called the women's husband. After the husband came he left. She went and lodged a police complaint and my friend was charged on 279 and 338. The first hearing is in february i have the below questions
1. can my friend do out of court settlement with the person injured.
2. what will happen in case of out of court settlement as i read somewhere that 279 cannot be quashed even in out of court settlement by sessions court and need to be done by high court.
3. what are my friends options is out of court settlement best option how will he be free from both 338 and 279?

The owner is not traceable have not met him all these years.Tried hard locating him a couple of years ago but they say that he is not around nor do they have any documents wrt the property as I had wanted to buy it.Now I want to transfer the property in my name as I am stuck in a limbo.I want to give it out on rent so what are the options that I gave considering that the owner is not around and I cannot buy even though I wanted to. Is there any tenancy or legal rights.I will pay the owner if he comes someday but in the meanwhile I want to give it on rent as somebody has given me an offer. Please give me all the possibilities available. Thank you.

My situation is a below,
My uncle is trying to extort money from my father. A property was sold, in which we distributed money among each other, but he tried extorting us while we were at the place, and framed us in a fraud case of hitting a dalit, and then asked us in return for 30 laks, 10 of which we paid in cash, rest we said will arrange. Now he is sending threats about doing more.
What legal measures should we take? If anyone could help out, it would be really helpful

i got marriage on 29 may 2010 but after 1 year that i found i got cheated from my ex wife & in law family regarding her education while that she get the for B.E. higher education but she did not get admission in collage.When ever i got facts i told to her for mutual divorce.She got agreed but after the putting the mutual divorce petition she not appeared in court after cool off period.Then after 3 hearings my self requested to court dismiss that mutual divorce petition & i got it.Petition dismissed.
After i i have putted separate divorce petition with lea-gale facts regarding to cheat.
At least 5 hearing the did not appear in court while that already court send the samman 2 time & also published in news paper.But she did not appeared in court.Then finally in January 2015 i got ex party decision & decree for divorce.
But not she againly putted divorce petition in same court after 3 years.
So pl tell me whats may be happened & whats should me do?Can she claim for alimony or can she demand for share in my property or can she apply for 498a & domestic violence.

I have applied for the mutual consent in chennai court. my advocate provided me with the case number where when i searched for my case status in [http://services.ecourts.gov.in/ecourtindia_v5/#] i was not able to retrieve my case. as well my advocate is asking for rs.10000 just to get the order copy. can anyone please help with the case type for mutual consent and how to apply for order copy online. Hi,i was plaing to buy land in bangalore, and that property(land) had a litigation as one farmer had sold the land to housing society and housing society didnt pay full cash to farmer so the farmer had put case in court for settlement,so the housing society gave back land to farmer and the farmer had returned the amount what ever yhe society had paid to them, later socitey had put case on farmer saying farmer have to pay interest for the amount paid by society for time being and in mean time farmer Sold off the land to other party(3rd party) and now that 3rd party is selling the land to us, so if we purchase the land by 3rd party, do we have to face any legal issues? Please advise on this.
