when there a suit is still in process for recovery of open plot property, which has been bought by an NRI husband in the name of his wife in an Indian city, is sold by her without the knowledge of her husband and later obtained (while the suit is pending in a court in India) a decree of divorce from abroad. i would like you to suggest what are the effective legal measures to be taken against her.
does this come under contempt of court & also whether she loses her right to defend the case after taking divorce while the suit is pending in a court of law, if so

A mortgaged propery with bank by depositing title deeds.Thereafter exchanges it with B. B sold the property to C.C raised construction by spending huge amount. Bank initiates recovery proceedings under securtisation act.Proceedings before debt recovery faild. C compromises with bank and pays certain amount to bank. Remedy of C against B?
whether entitled to only sale price or amount paid to bank under compromise and expenses incured in legal proceedings ?

hi, in the previous set of Q&A, I had asked that in Bengaluru and may be elsewhere, there is this arrangement wherein tenant pays say for eg, Rs 2 lakhs and stays for 1 or 2 years and when he leaves the entire amount is paid back. In reply the Expert said it is neither lease nor rent, but a kind of mortgage. The answer seems scholarly. In that case how do we style the agreeemtn, what should the agreement be titled as, and also the opneing lines of the agreeement.

Dear Sir,
One of my client taken a loan from reputed financial Institution and paying interest 17% p.a. (flat rate). He use to pay the regularly till Oct. 2009. Due to non receipt of regular collection he is not in a position to pay emi of Nov. 09. One of the person advice him that if you continue for 3 to 4 months (non payment of emi) the financial institute will ask for one time settlement with lesser amount than the due amount. My question is that the suggestion given by the person is correct? If he do so what will be effect or action will take financial institution against him for non payment of regular emi? or they may come for one time settlement ? Pl. suggest

A person has filed a suit for permanent injunction and accordingly the Hon'ble court restrained the defendants from evicting or dispossessing the plaintiff from one of the floor without following due process of law. The defendants are further directed not to sale, transfer, assign and create third party interest in the suit property. Please clarify the following querries:-
1. What is the exact meaning of suit property ?
2. Whether the above said order is applicable for entire house or the particular floor which is under the possession of the plaintiff.

HINDU SUCCESSION (AMENDMENT) ACT 2005
"On and from the commencement of the Hindu Succession (Amendment) Act, 2005, in a Joint Hindu family governed by the Mitakshara law, the daughter of a coparcener shall,- (a) by birth become a coparcener in her own right in the same manner as the son; (b) have the same rights in the coparcenary property as she would have had if she had been a son"
Please any one can explain me about "coparcenary property" as per the above law in respect to women's rights over property. Is that women has to be 4th generation (That is property should pass from her great grand father). Otherwise her father can dispose to any one of his choice as per self acquired nature. Thanks.

i purchased a electronic product on phone from a local dealer which deliver by him at my home with proper warrenty card and receipt. but product is not working . i call him but no one recived call mobile switch off(all three no mention on warrenty card), when visit the address then owner of this show me fir that wrongly use the address by seller. the owner of this address tell that seller come his office for take a shop on rent but he refused because no shop vacant. what should i do. any use to file consumer case or police fir. i more thing i want to share that i have doubt on owner of that shop. and i donot have any faith on our polish.
