power of attorney

Power of attorney executed by a person who is the joint owner of the anscetral property, other joint fly members does not know this, so is the power of attoney executed by sole member without others consent, a valid POA or its null n void? still property is not partitioned.

Joint Agreement of father & Son..

A father and a son both have a flat in their Joint Names i.e. both have signed a JOINT AGREEMENT. The maintainence receipt comes in fathers name only.But, the son is not aware whether the SHARE CERTIFICATE issued to them from their society does bear his name with his father jointly or the share certificate has his fathers name only on it.

At present the son is residing seperately from his father because there are some disputes going on between the father and son, the son wants to know whether can the father sell the said flat alone without knowledge of the son and without any share to son? Asking for urgent reply.. Thanx

Revoking a Gift deed by family members

Dear Team,

I would like to know if a gift deed can be revoked.
My father had gifted a piece of land to my sister on which there is a house constructed where we( me and my mother) live. My father is no more with us. The gift was done through registerd gift deed.Can we revoke the gift deed? if yes then under what circumstances? and one more question does the donor need to take the consent of others while gifting? Our father had done the gift deed for the purpose of construction of a building as he was over the age of taking loan and I did not have the eligiblity to take loan. Please guide me.

PIL regarding

Sir,
1.kindly intimate whether I can file a PIL directly in High Court, Mumbai or have to go through lower court.

2. Kindly also intimate whether a case can be lodged directly in High Court without going to lower Court

3. Kindly give me idea about free legal aid so that I may fight against a Govt. Organisation who has not yet paid my dues. Since I am not in a position to engage costly lawyers due to my retirement

Regarding eligibility of exemp.u/s.10(10C) by SBI VRS Optees

Sir,

Pl. give me a latest judgement in respect of VRS taken under the exit option scheme of SBI. Kindly advice me whether the SBI Exit optees are eligible for exemption u/s. 10(10C) of I.T.Act or not.

Agreement to sell / ownership

Thans for your valuable time.
Furthe details are :
My husband is the seller and rented out the flat. I had lend money from my brother n sis and given full consideration amt to my husband. Yes sale agreement is registered where rs 5 lac is given to him in agreement and he is bound to transfer in my name after reciving the full consideration and after march 2006 as per the society rule (this is the part of agreement). And we have executed other reciept of Rs 20 Lacs in dec 2005 and also said in the reicpt that he has handed over the possesion to me . After this i get done woodwork n interior of the said flat.I comleted my part of the contract but he failed to do so.

I have alredy taken stay on the flat and filed case to order him to transfer flat to me and hadover the possessiont to me which has been taken forcefully and its taking long 4yrs and still pending.

But he is enjoying the rent and living with other woman. we are not divorced and i dont have house to live and he is not maitaining me properly.

Plz advice accordingly now?????????
Can i get benefit of the rent?

Is there anyway i get possetion as he has forcefully entered as keys are with me only ?

I know its going to take long may be supereme court and i dont have house to live and my husband is not maintaing me properly living with other women can i claim live in that flat

criminal complaint u/s 200

Respected sir,
First of all i would like to thank all the members for their valuable suggestions/advice given to mne .

As i have filed a criminal complaint for the act of offences made by the other party u/s 192,197,199 and 200.
After all the evidances and honble judge sahib has teken into the coginance and issed the summoning order u/s 193.
Now sir kindly tell me as it is a criminal complaint the other party has to take the bail in this case and how long it will take to reach upto final stage and will any puni9shment is to be awarded the accused.

Advice

We have a College named as DAV College in which we have two blocks in one block we are running regular college & in other block some courses like BBA, BCOM, Bed, under Self finance scheme in other block under one Principal.
Now we are constructing a new building in the same campus of the existing college & we want to name it as a DAV Girls College under a new Principal & to shift the courses of Self finance scheme in that building.
We want your esteemed advice on the following:
1. Can we run another college in the campus of the existing college legally as per the guidelines of U P Govt. Education & ugc laws? If yes, then quote the sec. & G.O.
2. If yes, will we get recognition & affiliation from UGC, NCTE, AICTE, & the University?
3. Also advice us with other relevant information in this regard.
