Hindu Undivided Family

Dear Sir,

I am practicing as an Advocate in Kakinada Bar (Adhra Pradesh).
I have a doubt that A, B and C brothers
A is an elder brother maintaining the business in a joint family, but there is no paper evidence. But some properties like i.e., Boats in the name of three brothers. As the mater stood like that, "A" became week and "C" took maintenance of the business and with the profits of the joint business he misused the the funds and with the profit money "C" Purchased lands, Building on his name and his family members sons and daughter name. Now can "A"s Grand son can file a suit against "C". and can he get the property. Suggest me some case laws on this point.

Input Tax Credit under Karnataka Vat

I understand that a Notification has been issued under the Karnataka VAT clarifying the Declarations to be given for availing Input Tax Credit during the year 2009.
Pl clarify:
Is it applicable for existing Dealers also or for new registrations only.

Also what is the Number and date of Notification and has it been implemented now.
Is there any format for compliance to be done.

Saledeed- reg

My Grandfather owned properties in TamilNadu. He partitioned his properties to his four sons by way of “KOORCHIT” in 1947. I was given to understand that koorchit need not be registered and it is a legally valid document.

But recently in a land dispute , an enquiry officer ruled that koorchit being unregistered is not legally valid and saledeed of 1981 executed based on this koorchit is not valid.

Is it right? Kindly enlighten me .

Request advice

Respected sir,
My wife has filed DV/DIV/$98-A against me and i have more than 100 evidences for that all these are false and febricated.
I too have filed a criminal complaintunder sec. 200 crpc in which she has been issued summon u/s 193 of IPC and in DP 3(u/s 388/506/120-B) in which order is at final stage and waiting for the order since 01-10-09 and NDOH i.e for order is 20-12-09.
Now they want to settle down , but actually i am not interested, i donot want to marry in future. They want me to agree for mutual diverse. First i was ready to give the divorce, in one condition that they have to give me the physical custody of my son who is 8 yrs old, they agreed for that and want two lacks in liew of that. I too agreed for that . But that that there was no response, But i want to take a advise from you that in case, they are not giving me the custody of my son, because they know the my father is have a proper of nearly 10 crores and they told some one that after the diverce and when my son will be completing the 18 years. He will fight for that. Is there any provision that my son cant not claim, my parents property, evedn ansestor property.

So i will take my decision after that.

lease agreement

I want to take on lease for a period of 20 years of 300 sq yds site for running an Industry form a person who is having SALE CUM GPA from the owners and that SALE CUM GPA is in forceable condition at present. So please suggest me the procedure & conditions for obtaining lease deed from the GPA Holder

Bombay Public Trusts Act

Background: Every trustee has to keep regular accounts of the trust which have to be audited annually by Chartered Accountants or persons authorised under the Act. A Chartered Accountant can audit accounts of any public trust but the persons authorised under the Act are permitted to audit accounts only of public trusts having a gross annual income of Rs. 3,000 or less.

Query:
Who are the persons authorised under the Act? What is their qualification? Where they needs to be registered?

Security Deposit

Dear All,

I am planning to take residential flat on leave and license agreement, i have following query
1) Can i enter into 36 months contract?
2) What is diff between Lease and leave & license
3) Flat owner gave me following 2 option for compensation
a) Rs. 7 lacs refundable deposit + no rent
b) Rs. 10,000 Rent + 1 lacs S. deposit,

If i opt for option no 1 then what precaution i have to take or which clause should i write in the agreement which will safeguard my money in case of owner solvency or bankruptcy.

Except Chartered Accountant, who is a person authorised by the State Government under subsection (4) of section 12D? What is the qualification required? Where to apply?
