One widower (around 55 years) having son and married daughter wants to marry with his relative who is widow (around 52 years)having two married daughter. That widow is also ready for the marrige but two daughters of that widow are not ready because caractor of that widower is not good and they wants to stop that marrige. How they can stop that marrige legally. Please help and advice.

hi this is regarding divorce i need as soon as possible from my husband who is not mentally fit who has tried to commit suicide many times and always puts blame on me for my character i have a son of 5 months old now he started sending all dirty and third grade messages on my cell and everyone's cell in my family and even my friends and he says i had affairs before my marriage i had friens but i never had affair with anyone i am living with my parents and he had taken my cell long back from me and he doesnt used to allow me to talk to anyone from my family even if spoke to my jijaji he used to tell i have affair with him i am really fed up of him.now he says i have phone numner of a guy called as hussain and i will get all the recordings of the calls i made to him and i will prove ur affair,and his language is so cheap and vulgar in all his messages i just feel ashamed to tell those things.and he sends such messages to my friends also who are girls.please help me how to get rid of him and i am getting scared of the thing which he told about the recordings of the calls made by my cell.i have not seen such a third class man in my life please help and reply soon.

Can any Execution Petition, is filed along with a petition under Section 5 or 14 of Limitation Act by a bonafide pursuer,"in case of after 12 years, from the date of decree" is maintainable or not. If so, can you refer me a Apex Court finding against this.

Dear Sir/Madam,
Our builder from whom we purchased flat refused to register the flat by asking for unreasonable charges.We filed a complaint in the state consumer forum,Karnataka and Builder then revealed a pending dispute between the builder and landowner and hon'ble high court of karnataka restrains him from alienating the property.Hon'ble forum after hearing granted him one year to register the flat or refund the money.In case of registration we(DH) were ordered to bear the difference in registration and stamp duty.
One year went by and when there are only three days to the timeline given by stateforum,builder sent us letter to pay Rs 5.5 lakhs as service tax + vat + registration + stampduty against the court order which cleary says we have to pay only the difference in registration and stamp duty.
Also we came to know that the non alinenation order passed by high court of karnataka is still in force as the disptue between builder and landowner hasn't settled.We went and filed an EP and the builder appeared and said he is ready to register.Stateforum failed to notice that the high court non alienation order is still pending and dismissed our EP saying that "since the builder is ready and willing to regsiter the flat ,EP is dismissed.However if the DH is interested in getting the flat registered they are directed to approach the JDR and execute the deed as per the terms of the agreement as directed by this forum in complaint xx/2007."
Our builder says EP is dismissed and i have now pay Rs 40laksh as per the terms of the "sale" agreement.What we contend is that EP dismissed referring to the earlier order not eferrring to the sale agreement.
We filed another EP deteremined to bring to the notice of the state forum that builder cannot register the flat as high court order still in force and praying for the refund as directed by the forum in the decree.
In this regard i need few clarifications from this forum
1.Can the order given earlier by State forum be changed when it comes for Execution Petition?
2.What if the forum fails to consider that builder cannot register the flat as the high court order is still pending.
Builder cannot register the flat as the high court restrains him from doing so.Neither he wants to refund the money.Instead he is putting blame on us saying we are due Rs 40lakhs more to him for a flat costing Rs 28.5 lakhs which we already paid.
Please give your valuable suggestion as our next hearing is scheduled for 28/01/2010.

sir actually matter is that my mother & father are practising in high court of chattisgarh, bilaspur.
one petitioner has given a case to my mother .initially he made affidavit in front of oath comissioner for his own WP (criminal ) matter.
as a result my mother filed an WP (criminal) and also a suit for declaration and injunction before the civil court against the respondents B.
Thereafter petitioner changed his attitude and denied that he has not given any power (vakalatanama) regarding the above said case & he also denies filing of any petition before the said court. When my mother appeared in the civil court , petitioner denied and engaged another counsel regarding he same . before the civil judge class iv ,matter was heard in absense of said petitioner and newly engaged counsel as a result,court dismissed the petition due to non appearance.
Now after few days petitioner of the above said case filed a complaint before JMFC, that we have taken money 2,50,000/- RS for the court fees and we have not filed the case suit,in addition to complaint it is pertinent to mention that petitioner told in their complain that they have drawn the amount by self cheque but in police complain they told about cash payement to us.
in police investigation it is mentioned that cheque is drawn as self cheque by
the petitioners itself.
but now JMFC has registered section 420,467,468-34 of IPC and summoned. sir now what to do prevent from warrant . is there any danger of arrest.which court to be approached
current query:- after court has summoned on 20th january 2010 and next hearing is on 24 february, can police trouble(arrest) us before 24th february 2010, and on day after tommorow i.e. 27th january we are filing revision in the court of DJ against above mentioned sections.
now question arises do we still have to appear on 24 february i.e..., next hearing.
Now what action we should take against the complainant petitioners i m very much worried.
sir please reply and question any imformation you require sir its urgent

Resignation without notice period
I was working with this company for one year.
i have left the company in Dec'2009.
Initially i gave them notice of 3 months, but i couldt complete that, so i served only for 20 days.
I have not received any acnowledgement of my resignation nor any final settlement.
Now they are planning to take a legal action against me.
can they do that?
They are asking me to pay three months salary.
Cant you please tell me what is the calculation, do i have to pay full salary for three months or only basic salary of three months?
Please help.
