in a summary suit filed by one advocate "A" in the year 2002, the respondent served with the summons in 2006 and affidavti of service is also filed in the year 2006 and as per the direction of Hon'ble j.m.f.c. matter wasadjourned for exparte evidence.
in 2009 one another advocate "B" engaged by the plaintiff and joint vakalatnama of "A" & "B" filed. since 2006 till 2009 the advocate has not filed affidavit of ex-parte evidence. the advocate "B" has prepared the affidavit and handedover to the advocate "A" to file in the court.
on the date due to some wrongful noting in roznama the court has directed the plaintiff to serve the summons upon defendant. the Advocate "B" appeared at that time has not tell and clarified the court that the summons already served and matter was already adjourned for ex-parte evidence for the reason best known to him.
now on next date the advocate "B" appeared and clarified everything before the court and as per the direction of the court made an application for necessary correction in court's roznama and alongwith application tendered the affidavit of ex-parte evidence in the court and the matter was adjourned.
on the next date when the matter called out one advocate appeared on behalf of defendant as the defendant was served with summons. the Advocate "B" made inquiry and came to know that behind his back and without the knowledge the Advocate "A" has re served the defendat with summons.
my query is that can Adv. "B" proceed with matter as ex-parte or on the basis of resummoning the defendats can have right to file their written statement?
what remedy for Adv. "B"? under what provision?plz give citation if any is available.

sir my aunt is not educated and wants to apply for PAN card in her name and she is not working anywherebut gets money from her son living abroad,she has a voters card ,Can she apply for a pan card by producing that voter card as age and id proof?She even has a savings bank account in her name.Please advice us if we have to produce an affidavit for age proof.

Can a sole proprietor executed a gift deed in favour of himself and with others?
Eg. "ABC" is proprietor concern represented by sole proprietor "D". sole proprietor "D" purchased immoveable property is the name of ABC. now ABC represented by sole proprietor "D" wanted to execute gift deed to his sons and himself.
Wheather such gift deed is valid or not.

I purchased a product from dsf technologies which runs a website gadgets.in
Total fraud company with idiot managers
I purchased button spy camera with extended battery back up for Rs 5600 . Manager Mahesh who is a big liar told me that the product will do 7-8 hours of continous recording . After i used the product i came to know that the it was only doing 2 hours of continous recording and after 2 hours ,it automatically shuts off . I told the problem to the manger and he asked me to send back the product and they will get it replaced . I sent back the product But after few days they told me that product is ok and will only do 2 hours of continous recording and that has been verified from imorter and china . I asked the manager mahesh ,then why he sold me the product saying that it will do 7-8 hours of continous recording . Then surprisingly that bastard told me that he never said like this . I asked him u even didnt knew that it only does 2 hours of continuous recording then he said that he knew that but he didnt tell to me bcos i didnt ask . Wht a shocking answer from such a big liar .
Mahesh if u knew that it does only 2 hours of recording then why u asked me to send back the product .
Now they r not even refunding my money and mahesh,the manager is a big liar
These people r running company in a residential house in delhi and there is no way to contact the owner of company . they just smuggle products from china n sell on double rates in india . and the quality is the worst . so people avoid purchasing gadgets or products from gadgets.in

My first question is in case of a lease deed, as per law who shall pay the TDS (lessor OR leasee )?
Clarification : We have executed an agreement where the rent of the building is 15,500 which is for a period of 3 years. The lessor is not ready to pay the tds. What is the option to the lessee ? Will the tds amount will be refunded showing the tds certificate ?
I would appreciate any help on my above queries.
