hiii advocates
when a bye law of a club will become effective? as soon as when it is passes in ec meeting or after filing with the registrar?
does club can terminate any probationary member from the club without following principle of natural justice ie memo or show cause notice.
whether club can amend its rules n practice or bye law in violation of standard format n if does so will it become a rule without even filing with registrar

may i please be advised on how to prosecute for insufficient funds as per payment and settlement act 2007 for electronic clearing cheques( as 138 in negotiable instruments act )

Ever since I joined Madras Law College to take up Law Study, I had a serious doubt in my mind as to the Bigamy Laws in the country. Since I did not take up Advocate's profession as a full fledged career, I never got any opportunity to get the legal position clarified. The issue is Bigamy laws are very strict in our country for Government or Public Servants only as they are even denied with the Service Benefits if they commit bigamy. Even if he/she is a family pensioner, he/she needs to submit Non-Remarriage certificate to claim even Pension.
MY QUESTION IS: How our People's Representative (MPs/MLAs/Ministers)who are the Law makers of our land can commit the same act of Bigamy and still get recognized by the Law of the Land to claim and enjoy all service related benefits. I may please be corrected if I have misunderstood the basic tenets of Bigamy Laws.

I HAVE SOME QUERY ABOUT THE LABOUR LAW RULES. PLEASE GIVE THE ANSWER.
1.CAN A COMPANY HIRED SR. LEVEL EMPLOYEES ON STIPEND BASIS.
2 CAN A COMPANY SAVE THE ESI,PF, OT AND OTHER BENEFIT BY SHOWING THE SALARY AS STIPEND.
3. CAN A COMPANY SHOW TOTAL SALARY AS BASIC AND DA FOR ESCAPE FROM THE ESI,PF LAW.
4. CAN A COMPANY TAKE THE SERVICE MORE THAN 8 X 6 =48 HRS IN A WEEK WITHOUT ANY OVERTIME.
5. CAN A COMPANY CHARGED FOR PROVIDING 3 TIME TEA DURING THE DAY AND BRUNCH AFTER 6 PM FROM STAFF AS CANTEEN CHARGES ON COMPULSORY BASIS.
6. IS IT COMPULSORY FOR A COMPANY TO PROVIDE THE MEDICAL FACILITY THOSE EMPLOYEES WHO IS NOT COVERED UNDER ESI.
7. CAN A COMPANY MAKE ANY RULE THAT IF THE EMPLOYEES GO BEFORE THE OFFICE TIMING THE FULL DAY SALARY WILL BE DEDUCTED.
8. IS THE SHOP & ESTABLISHMENT RULE CAN BE APPLICABLE IN A LTD. COMPANY.
9. CAN A COMPANY MAKE A RULE FOR HOLIDAY THAT THEY WILL GIVE ONLY 4 HOLIDAY IN A YEAR INSTEAD OF 10 HOLIDAY.

sir,
my grandfather purchased a property in mumbai suburban in 1975.in 1980 he attached with his freind for devlopment.that man cheated grandfather and 6 other person by taking advance .withought completing same he ran away,than my grandpa made agreement with other devloper,that man completed remaining work but he alloted a flat to a lady.now that lady had captured all 8 flats and taking rent of that 8 flats.still all doccument is belongs to us.now i want to sell that property and want to get rid of case filed by that 6 mans who had given advance.my grandpa,that lady.freind & othres are accused in same.so what is your suggations.the case is still not came on board and the main accused freind died in 2006.

Friends,I convey my deep gratitude to LCI site which helped me to score good marks in Corp Law,Banking/Ins.Laws and Taxation Law papers of CS-Final exams which I qualified with 61% avg. The results were declared recently. Now the big qn.is whether to quit Central Govt service which I am in for the last 22 years (I am 43 now)working as Stenographer drawing 32k/pm. My Ministry does not require a CS and probably I am the only qualified CS in the entire Ministry.
In all the levels of CS exams I scored avg.of 61-62% which is nearer to the all-India rankers.
I seek your kind advise so that I successfully begin 2nd innings of my career life. Thanks and Regards

Successful Career as a Lawyer
When I finished my law degree during the year 1988 and gearing up to take up the profession, I was advised my one of my close relative about the prospects of a successful lawyer (who himself is a well established Senior Advocate). If one has to become a successful lawyer he needs three entities to become successful. I was totally misled by his advice and got diverted to take up employment. I regret that decision even today when I feel that this Noble Advocate's profession would have extracted the best out of me.
I need our honorable experts guidance to the student community to spell out the Best Ingredients that any Lawyer should possess to become successful in the profession. Please join this debate.
