Repeated adjournments without reason in Consumer courts...

I have filed a case in a consumer court. The opposite party has filed a vakalat stating who is representing them. After that they are not even appearing in the court for any hearing and the judge too is just giving ajournments in one month periods. So far 5 such adjournments have been given. According to Consumer Protection Regulations, 2005 and even a Supreme Court Order in the case of Civil Appeal No. 7975 of 2001, it has been clearly stated that the opposite party can have only a maximum of 45 days to file their version. In this case they are not even appearing, let alone asking for adjournments. What can be done by me to inform that court that they have to now decide on the case or take the next step?

Law commission of India 71st Report?

Dear Experts, I want to Know whether Section 13C, which was recommended by Justice H R khanna and P M Bakshi, members of the Law Commission of India in their 71st Report about irretrievable breakdown of marriage as a ground for dissolution or Divorce of Marriage with few safeguard to the existing sections of HMA 1955 Does Section 13C is in practice or not enacted into Law, if not can that section cited in along with 13A to file a Divorce Petition?

Can any random lawyer appear for hearing?

I have filed a complaint in a consumer court and I appear as 'party in person'. The opposite party, a bank, has appointed a lawyer. The lawyer came only the first time to file the vakalat. From the next time onwards he sends an office peon who goes about the court trying to convince one of the lawyers there to appear as the opposite party. Is this legally allowed? My understanding is that the lawyer on record if it is a firm, has to send the same lawyer. And in case the lawyer is doing the wrong thing what are the steps and measures I can take?

method for action against complaint

Hello,

As you all know that I am having matrimonial dispute with my wife for past 3 yrs.

Just 60 days before, I have given one complaint at police station against my in-laws that ".....they are coming to my work place carring knives, asking/enquiring about me.....etc...these all things are told by my work place neighbours"

After some time I filed an RTI application and ask for action taken report.

In reply they said
"NO ACTION HAS BEEN TAKEN SINCE IT IS NOT A CONGNIZABLE OFFENCE"

What should I do, so that the police must take some action on that complaint.

Dear sir/madam,
As all of are aware we are required to get one's marriage registred before the marriage registrar once a person gets married. but what in case of a divorce? is there any provision to get the registration of the marriage cancelled after one is divorced? how do we do it?
can i please be guided on the topic?


I do agree with all of your views that once a divorce takes place, the decree is in rem. but what if the other party tries to take undue advantage of the registration (marriage) certificate, as the certificate is not cancelled. the parties have to produce the divorce decree to show they are divorcees. but may be there can be misuse by the other party in getting passports, etc. so how to protect oneself from such misuse? even if a person is a divorcee, if the marriage certificate is not cancelled, there is a chance of misuse of that certificate.
