Sir,
I need certain clarifications on exparte divorce. Kindly go thorough the matter and kindly give valuable suggestions::
I have applied for divorce at District Family Court due mental cruely of wife. Case hearing was happened at Family court
I got EXPARTE JUDGEMENT ie divorce granted.
One day after judgment day, I have received a letter from her (Wife) high court lawyer stated that "petition filled at Hon.ble High court for transfer of the divorce case to her (WIFE) working place and stay order for four weeks for the divorce case is issued by the Hon.ble High court". Actually she (Wife) filled a petition for transfer of the divorce case and got stay at 12 days before the family court judgement day.
That is, the stay matter is not known to me and my lawyer before the judgement day. Besides, she or her lawyer is not informed the stay matter to the family court during hearing. No official court order is not received by me till now.
In that crucial matter, exparte judgement is given during stay period of Hon.ble High court (Stay matter is not known to me or family court).
I kindly asked that whether the exparte judgement is valid or not?, besides reappealing by her for exparte judgement ie 90 days is also already over at family court. Till date no reappealing by her.
Kindly give valuable suggestions and directions.

A client of mine is not being allotted duties for the last 2 months. He is coming and going to his office regularly but no work is being given.The reason is only the ego problem of his immediate boss.He has also poisoned his chief boss so when he went to the chief boss he asked him to contact the said person who allots him the duties. He is receiving full salary. But he is mentally depressed,dejected and stressed with frustration. He feels that he is under mental abuse at work place and is gradually loosing his self esteem. Should he approach the Human Rights Commission for restoration of his duties? What are the remedies available for this?

sir me school me affdevit le kar gaya tha par unhone magistrate se order nikalwane ke liye kaha. kya magistrate order nikal kar de dega. kya magistrate ke order ke sambandh me koi paper nikalta he kya.

Filling the post of CLERK without advertising for the same in a govt. deptt.,by just promoting a Matriculate peon. Whether it is sustainable in the eyes of law?

my house was searched by police from outstation by search warrant issued from the court. During the search the local police, my estranged wife who got the search order and the outstation police were present. the outstation police had asked the local police to accompany them. During the search for my wife things... the entire proceedings was video taped by a person whom we didnt know but was with the police.... my wife was accompanied by her lawyer who refused to be identifed during the search and was there during the entire search.
1. Can the local police also be there for the search along with police authorirsed for search?
2. can this search be videotaped? if yes by whom? can wife arrange the search to be videotaped or only police can? does she have the right?
3. can her lawyer come to my house during search and be there during search? if not can i ask her lawyer to leave my house?
4. Can I ask for copy of the video tape taken during search and also details of persons present during search through RTI?

SIR,I'D GONE INTO A LEASE AGREEMENT WITH THE BR. MANAGER OF E.D. BANK FOR 5 YEARS NOW 3 YEARS HAVE PASSED AFTER THE EXPIRY THE TIME PERIOD OF LEASE AGREEMENT HAS BEEN COMPLETED BUT NOR THEY ARE INCREASING THE RENT NOR THEY ARE EVICTING THE PREMISES EVEN AFTER SO MANY REQUESTS HAVE BEEN MADE BY ME TO THE BRANCH MANAGER AS WELL AS TO OTHER HIGHER OFFICIALS OF THE BANK. NOW THEY HAVE WRITTEN A LETTER TO ME THAT THEY HAVE INCREASED THE RENT BY RS.600/-,WHICH IS NOT ACCEPTABLE TO ME , AS THIS IS A VERY LOW RENT AS PER THE MARKET RATE. ALSO THE LEASE AGREEMENT IS NOT RENEWED NOR ANY REQUEST HAS COME FROM THEIR SIDE FOR DOING SO.PL.TELL ME WHAT TO DO?

Generally it is seen. when the police seeks remand, magistrate grants without looking the legality and without carefully checking the case diary.
One of my client was caught was with "Jangali Lahsun" (Alium Atrachiyi). He is the resident of high altitude of himaliya and collection and cultivating herbs is their main source of bread. Police sought remand that it was removed from reserve forest. Remand was granted under Section 26 Indian Forest act. At the time of hearing my argument was, police is unable to show that collection of this herb is prohibited illegal under particular law. They only says that it was removed from reserve forest. even police does not know the botanical name of this herb or it's use and unable to say that this area comes under reserve forest. my bail application was rejected.
My question is that if without any prima facie proof of offence court grants judicial remand. What is the remedy against such baseless remand order and illegal detention specially against officer granting such remand believing on the story of police.

Ld counsels,
In a writ case challenging the order of the infomration commission the public authority has not included the information commission as a respondent rather included only me (RTI applicant) as a party.
Now I want to include the IC as a part inthe proceedings. Under what provision of law I can make that petition. I was told that I need to file a Misc Petition (MP) in the same writ proceedings. Is there anything called impleading.
Please clarify.

Possession of child
I am married since last one and half year. My inlaws stay in Pune and me and my husband stay in Mumbai. I am into business since last three and half years and stabilized in it. My husband was also working in Mumbai at airport. I was sent to my parent’s place,who also stay in Mumbai for the maternity period in November 2009. In February 2010, I delivered a baby boy and then my inlaws themselves decided that we both should leave our existing work and stay in Pune with them. My husband without taking my consent left his job and shifted to Pune permanently. He doesn’t even have a job in Pune now and now trying very hard to get a job related to international airport in Pune which is difficult.
I informed my husband that I am not willing to close down the business in Mumbai which after my three years of strruggle has now stabilized. Initially my inlaws were forcing me to leave my career and stay at home and now they asking me to again start a business in Pune(which I am not willing to and will be very difficult for me). Also my father in law told me that he will take legal actions for getting my son.
I had approached to marriage counseling but my husband and inlaws started lying and made some other story and blamed me and my mother for various reasons. The conuselling authorities advised me to go to the family court. Now there is no contact between me and my husband and inlaws. And now I have decided that I don’t want to go to them at all.
I don’t want to go to the family court as my husband and inlaws lie a lot. What will happen if I don’t approach the family court?
Please advice me
