Dear Experts.
I am an advocate and I have been practicing since 21st Oct, 2009.
I have cross examined PW-1 and PW-2 reguarding pronote suit on behalf of Defendant. PW-1 in his Chief affidavit and in my cross examination he stated that he has given debt to Defendant for his family expenses and for the treatment of defendant health. Further he stated that he is doing finance business.
In my cross examination PW-2 stated that who is the father of PW-1 and also attestor of the said pronote like this his son has given the debt to defendant for discharging sundry debts. I questioned him that did your son (PW-1) has licence to do finance business. PW-2 stated that yes PW-1 has licence to do finance business. Even though PW-1 has no licence and not filed the copies of the licence. So PW-2 state falsely.
On the above two grounds is there any case laws to dismiss the suit.
Is the suit maintainable. It is my first case. Kindly suggest me some case laws to dismiss the suit.
thanks to every one who has read my query and for giving answer.

Do we have any time limit in a criminal case for 498a.
1) If the case is not chargesheet'ed from PS to court. Does this case expires automatically after certain time say
3 months or do we have any judgement or law for this duration?
2) In another situation what happens to the person on whom the case was registered and is pending. Does Police have any provisons in law to take action at later point of time say after few years? Does it implicates his job, travel abroad etc
Experts please give your valuable answer.

Dear All,
I would like to ask you a question about a property dispute which has happened recently in my family. I belong from Moradabad(Uttar Pradesh)
Today, i.e; June 30th' 10, my
uncle(father's brother) has done a fake property registry of my fathers land in the name of his son in law. The total area of land is 104.65 mtrs. The property is my my fathers name since 30-35 years and he has the baynama in his name since that time. Please advise if Indian law gives us any strong point of cancelling it.
Your advise will be of very helpful to us.
Please let me know your contact no, so that I can talk to you regarding this matter.
Your earliest reply will be highly appreciated.
Best regards
Faizan

I quit the organisation on 10 May 2010. The Gratuity Act had been amended and stated that the cap had been raised from Rs. 3.5 Lacs to Rs 10 Lacs. However, as this had not been passed by the Parliament, the approach was that the payout would be actual (subject to the cap of Rs. 10 lacs) but the amount more than Rs 3.5 Lacs would be taxable.
The Grauity Amendment was passed by the Parliament and came into effect from 24 May 2010.
Now, my company is saying that since I quit before 24 May, the payment that they will make now will be taxable (as was the rule till 24th May).
Pls confirm what should be the right approach
In a ancestral property card the one of co-owner submitted a copy of "PANCHANAMA" by forging the signature of the "PANCHS" & got entered his/ her name on property card which also is signed & attested by the "CITY SURVEY OFFICER."
What sort of action required to be adopted if a "panchanama" is found having forged signature of the "panchs" and provision under different section of IPCs for punishment?
Sale of unauthorized flat & Basement car park
Dear sir/madam
Our apartment building is more than 15 years old. There are 5 unauthorized flats. Recently a party has purchased a flat and occupied the same. The promoter has registered in favour of the buyer only the UNDIVIDED SHARE OF LAND and NOT building.I would like to know whether it is valid in law. If the transaction is illegal what is the action to be taken legally.
The basement of the building had been alloted for car parking as per sanctioned plan. The company engaged by the buyers of undivided share of land to construct the apartments has illegaly converted as shops and rented out. The basement is still in his possession. The company is not in anyway connected with the promoter. Its duty is only to construct on individual contrac basis. On the basis of honourable high court of Madras two judges bench judgement in W.A.Nos.116 to 119 of 1995 and W.A.Nos.775 to 778 of 1995 dated 13/12/2005 ( Madras Law Journal 2006 (1)CTC 241 ) through Assn. sent Adv. notice to the company to surrender the basement to us. And also the Assn. sent notice to local authorities in this regard, so far no action had been taken. Recenly the company started demolishing the basement and digging the floor and hence I myself filed a suit in city civil court and summons have been served. This the stage of the case. Anticipating with interest your valueable suggestion in this regard.
Thanking you.
