claim on inherited property

We have a 3+1 storeyed building constructed on a piece of land inherited by my grandfather from his father (ancestral property). The ground floor was occupied by my grandparents who are no more & the rest 3 flats were occupied by my father & his 2 brothers resp. My uncle had acquired a loan from some coop bank, which he failed to repay. The bank took legal action, against which he surrendered his flat as well as my grandfather's flat (who was his guarantor). Now to cover the entire loan amount the bank is trying to take charge of my father & 2nd uncle's flat, as they are inherited from my grandfather. Inspite of being innocent, my father & 2nd uncle have to suffer just bcoz they are related to the bank's defualter, which is so unfair. Plz. help us to get out of this mess! What appropriate actions should we take & how far would it help?

appearance of original petitioner

The original petitioner is being represented by GPA holder, now the court has asked the petitioner(abroad)to present himself personally in the court on 12-7-2010.I want to get the petitioner arrested because after attending the court he may go away abroad. What best charges can be framed against him,so that he does'nt leave the country unless the case is settled. This is a case of marriage annulment.Which was filed by GPA without the original petitioner's presence in the court.Since filing only GPA is reporting in the court. If he(original petitioner) does'nt appear the court has said the case will be dismissed.
I will be very grateful to all of the learned legal fraternity.

Cheating case

Hello All,

We had a land registered on my mothers name which is sold by my uncle without our notice so we booked a cheating case making the buyer also as involved in this and the court has forwarded this to the police station.

We are afraid that is there any chance that the investigation report can be changed with the political influence?

If they do so then what can be done so that the case should be in our favor.

We are very helpless as they have good political influence even after taking the injunction order we are unable to do any construction work. I don't know how can we over come this?

Thanks in Advance to All Experts.

Cross examination of witness.

In criminal as well as civil cases a witness is ready for cross examinations.

Example a firm filed a complaint under NI.138 and some person on behalf of the firm has come for cross examination.

The first question is asked by the defense advocate : can you prove your personal idendity OR do you have any proof or documents to show your identity NOW.

In most of such questions the witness says no. What advantage can be availed by defense in such situations.

enforcement of fundamental rights

sir, i filed an O.A. before CAT for enforcement of my fundamental right to equality, as i was kicked out, retaining my 31 juniors and CAT did not issue even a notice to the respondents and it was dismissed as time barred.
Can i move with a fresh petition under art. 32 for the same relief bypassing high court under 226?
