Gifting my flat to parents to prevent wife claiming it.

My wife has filed a false 498A case against me and my parents and can also go for alimony claim or claim a part of my property as compensation. I want to know if I can transfer my Flat to my elderly parents as gift? Can my wife still claim a part in the property?

Judgement after the case is quashed by high court

Hello All,

Thank you for reading my query and helping me out.

My cr case was quashed by High Court earlier this month and the order says that "The proceedings in C.C XXXXX/2017 on the file of XI Additional Chief Magistrate are quashed. The petition is allowed". I have a copy of this with seal and also copy from HC website.

(a) The case is still open in lower court according to ecourts website. My lawyer has asked me to come to court on next date so that the judge can pass a judgement. If the case is closed in HC would the judgement in lower court be anything bad? Is this normal procedure after quashing or can this be dealt without me going to court (as I am very scared to go to court).
(b) The case is showing as NBW online so does this mean there is a risk of magistrate getting me arrested?

The error is made in the order sheet. What you suggested is correction to be made in cause title through 151 CPC ie amendment of cause title by the petitioner.

I am asking how to make the judge change the names of parties typed wrongly in order sheet dicated by him and another foolish judge? Its a bench who has done this miracle.

Grandmother property

My grand mother(mother's mother) has a land 3000sq yards and she died and her husband is alive, someone occupied the land and my mother and her sisters given authority to their brother to attend court and fight for the land. Now recently we came to know that my mothers brother who was given authority made an deal with the other party for compromise and has taken money and case was disposed. Noone know about this. Now he is not giving money. What to do for this, in what way we have to file a case and how she can get money share..as a granddaughter I have any authority to file case or only my mother has to put. Please suggest me which type of case... Kindly suggest me

Partnership

Can a partner, out of the only 2 partners in a partnership write a will in favour of the other partner in context of the property acquired under the name of the partnership? if not then what is the procedure?

dv case

dear Sir.
my brother and parents becomes victims for dv case on 29-03_2015. till date she is unable to submit any evidence against them. and also she never able to submit the cdpo reports to the court. but she n my brother is intercaste marriage since 18 years. she made allegations that my brother had extramarital affair n he never shows affection on her. so our lawyer forcing to get compromise each other. we are denied to that proposal. so our lawyer still postponing the case giving simple n unusual reason. this seems he may not interested to continue the case. we are getting confuse n what can we do such things. my parents are suffering from chronic disease.
my question are
if she unable to submit the evidence, is it possible to dismiss the case in high court.
if yes what are procedure to led case in the high court.

please give me advice as soon as possible.

Right of Grand daughter on grandfather's property

Hi Sir/Madam,
My wife's grandfather registered his acquired land on my wife's name as a gift and he clearly mentioned that He or his successors can't claim on that land.Now my wife's brother demanding that all his grandfather's land should be converted on his name. My father in law is alive. Please tell me whether he can claim on that land or not and if he can claim what will be the share of each?

Obc ncl certificate

I belong to obc ncl since both my parent were recruited as grade 3 govt employees,

But while making certificate, i didn't mention my mother's occupation in ncl certificate. (i know i did a silly mistake).
Now i got a government job using that certificate.

Will it cause any problem in future?if so, can it be ground for prosecution bcoz i actually belong to obc ncl.

My husband has filled rcr three counselling has been over where he never spoke soft to take me back.the mediator said to proceed in the court.if the rcr decree is not given in his favour what will happen.can i join him after he loses his rcr..please help me
