Transfer of property after closure of pvt ltd co

Namaskar,

I hold a 99% share of a Pvt Ltd Co, and my wife is having the rest. A few years back we purchased office space in the name of the Pvt Ltd Co.. Now, due to some unavoidable circumstances, we want to wind up the company. We do not have any bank loans or creditors in the market.

It would be helpful if someone could let me know the procedure to transfer the property (i.e. office space) from the name of the company to the name of the existing directors (i.e. myself & my wife).

Mcrc 482 , mp highcourt jbp

What is the procedure to list a date for hearing ? Case is for MCRC 482 in M.P highcourt. We got a date 18 Nov 2022 ,it was listed also but CL number was around 100 due to which case was not heard. Then we got a date 25 Nov 2022 but it was not listed. There is no update in status of case ,no date has been allotted.
My first question is -

What is the procedure so that we can have date and is heards also ? We have asked our lawyer multiple times to do something to get the date , he said it depends on court.

2. In how much time will the case registered under MCRC 482 will be quashed ? Generally how many hearings it takes ?

Admissibility of evidence of criminal case in civil case

Hello,

I would like to know if evidence (statements and exhibits) from a criminal case is admissible in a civil case for compensation, and such evidence can be relied upon in the civil case.

Conviction was awarded in the criminal case, but appeal against it is pending before the High Court.

I found a judgment of Supreme Court that deals with admissibility of evidence between two criminal cases, and also two civil cases. https://www.casemine.com/judgement/in/5609aba4e4b014971140cf94

In the said judgment, it was held that evidence of one criminal case is not admissible in another criminal case. However, in (two) civil cases it is admissible when the parties agree or give consent.

What would be the legal position regarding admissiblity of evidence of a criminal case, in a civil case, and if such evidence can be relied upon in the civil case? Would such evidence be admissible with consent, if at all, and can be relied upon?

Please also provide important judgments/citations in this regard.

Can judge grant a relief to petitioner which neither the petitioner nor the respondent asked for?

Can judge grant a relief to petitioner which neither the petitioner nor the respondent asked for in the petition or counter? I mean, the petitioner asked for one relief in petition and the respondent just blindly denied all allegations without asking any counter relief. After the trial, the judge finds no merit to grant the relief asked by the petitioner but still finds merit to grant another relief which has not been asked by petitioner. In such a situation, can judge grant that relief to the petitioner by order/judgement?

Witness in cross examination stated " affidavit has been signed by me in my office"

Dear Sir,

1. Affidavit by way of Evidence was attested by Oath Comm and submitted before court by the Witness.

2. In Cross Examination A question was put to the Witness that " Where you have signed this Affidavit at Point "A" and Point "B"

3. In Reply, Witness stated that " I have signed this Affidavit in my office"

That Means, Affidavit not signed before Oath Commissioner Hence in My View That Affidavit cannot be read in evidence.
Hence I am looking at assistance from all my Senior and Colleague Advocate to assist me in providing Export Comment as well as Case Law on this point. Shall Appreciate
