Recovery of cash security in criminal cases

Can a legal heir of a deceased accused recover the cash security deposited by the accused during the pendenancy of trial of criminal case. Kindly mention the provision of crpc along with any judgment.

Sir my question is that can u be charged on 138 if ure not any way related with the check nor u have sighned. My partner had given his check towards a payment 4 a land we purchase now I have been sent notice 4 138 which im no way connected with the check kindly reply what to do.

Role of io in 498a trial

Hello Experts,

In my 498A trial, all witnesses cross is over, most probably next is IO's turn.

Could you please let me know what is role of IO in the trial ? As i understand IO came to know about all the crime by complainant and other witnesses. IO has not seen anything or heard anything personally.

In that case what kind of questions would be asked to IO ?

Is the procedure same for IO as well that first public prosecutor examines him and then accused lawyer cross examines him ??

Hi Team,

I have filed an application u/s 451 and 457 of Crpc for return of property.
Brief story of the case : My clients gold had been stolen from his house and the police have recovered the gold in form of ingots from 3 thieves. I need exact case law on return of gold ingots.

Section 420 of ipc

Hi team,
One of client has been charged under section 420 and 34 of IPC for cheating Municipal Corporation.
Brief story of the case :-
My client was registered supplier of Municipal corporation. He got the order for supplying material and he had supplied the material as per order. After 15 days the said complainant came to know the material supplied by the supplier/accused is of inferior quality. After receiving the letter from corporation the said accused immediately supplied the new material to the corporation. Despite of this fact, the corporation lodged a criminal compliant. Please support your answers with relevant cases laws of Apex court and Bombay High Court only.

procceding without opposite party's presence

Dear sir,

This is the case against builder in consumer court. The court has adjourned until next date with following is recorded in the court registry.

"Advocate for the complainant is present.
Advocate for opponent is absent.
Opponent has not filed written version.
There is no application for seeking time to file written version.
Therefore case to proceed in the absence of opponent."



Sir, there are lots of issues that builder may not disclose and argue against. That's why, I believe he has not filed written version. Now, I my querry is,

1)Is this situation benefecial for case matter to be finalised expeditiously?

2)However, if before next hearing, in case opponent file written version, will court admit his application?
