Can J.M.F.C has power to give bail to the accused u/s 364 of I.P.C?

Though there is no restraint on it to grant bail, it being sessions trialbe case the Magistrate never grants bail as judicial propriety.

Sessions Judge is empowered to grant bail in such case.
