Power of Attorney expired in 138 N.I Act case

In present case u/s 138 N.I Act the complainant is a N.B.F.C company and is hence represented by Power of Attorney holder who is a recovery officer of company. The P.O.A submitted by ccompany states that that it is valid till 31.03.2010 and on this date it will be cancelled automatically. Now the case has reached stage of Cross-Examination of Complainant i.e P.O.A holder on 28.06.2010 but the P.O.A is already expired and it has not yet been renewed yet moreover magistrate is not issuing directions for renewal of POA. What can be done in such a scnenario? I am appearing for accused and has already raised an objection, Kindly provide any solution.

Easement.

Meaning & Difference between Gratuitous & Non - Gratuitous Act.as per contract act, 1872.

Doctrine of restitution is not applicable to the minor WHY ? Also the doctrine of restitution required.

As Per Section 4 what is the meaning of Easement with the example(S).

Vakalathnama

My client is in judicial custody for non bailable offence. His wife approached me to file bail petition. My question is how I get the signature of the accuesed at vakalath and also on bail petition. Can I file vakalath and bail petition with signature of his wife or can I file bail petition without signature from accused or his wife.

Credit Cards Fraud

Hi All,

Can anyone tell me what is the punishment for Credit Cards Fraud and Internet frauds in India.

What are the evidences required in the court to prove the credit card frauds.

Under which sections the case can be registered and what will be the consequences. Also, please advise the procedure for registering the case- will the bank go and get the FIR registered or the Cardmember will be required to do so.

collage demanding capitation fees




I am student of final year BAMS COLLAGE OF RAJIV GANDHI UNIVERCITY OF HEALTH SCIENCES, KARNATKA , BANGLORE - 560041 AND RESIDENCE OF MAHARASHTRA.

I PAID RS.THREE LAKHS AS FEES TO MANAGEMENT THROUGH CASH AND DD, THOUGH FEES DESIDED BY MANAGEMENT IS RS. 40000 PER YEAR.MANAGEMENT CHARGED ME EXCESS FEES WITH COMPARE TO ACTUAL FEES DESIDED BY UNIVERCITY AND ALSO I PAID IT.

NOW I WANT TO DO ENTRENCESHIP AT MAHARASHTRA. I NEED A LETTER ( NOC OR PERMISSION TO DO ENTRENCESHIP AI MAHARASHTRA ) FROM MANAGEMENT. MANAGEMENT IS CHARGING RS 65000 FOR IT IN TWO INSTALMENTS OF RS 32500. I PAID RS 32500 IN BANK AS DIRECTED BY MANAGEMENT.MANAGEMENT HAS GIVEN LETTER TO ALL STUDENTS EXCEPT ME.FOR ME PRESIDENT IS DEMANDING RS ONE LAKH MORE.MY PARENT IS NOT CAPABLE TO PAY THIS MORE FEES.
WHAT CAN I DO ? PRINCIPAL OF COLLAGE IS WIFE OF PRASIDENT OF SOCITY WHICH RUNS THE COLLAGE.AFTER MANY REQUESTS THROUGH PARENTS PRESIDENT IS NOT READY TO ISSUE LETTER.
PLEASE GUIDE ME SO THAT I CAN HAVE ENTRENCESHIP AT MAHARASHTRA WITHOUT PAYING MORE RS ONE LAKH.

Cheque issued by employer bounced 2 times

Hi,
This is my first query on this forum, hope to get a reasonable advise from all the experts. My x-employer issued me 3 cheques in lieu of 3 months arrear salary. These were issued to me when they asked me to leave the organisation. They also provided me with a job satisfaction certificate and a document stating that the cheques are being paid in lieu of the arrear salary signed by the manager. The cheques were signed by the director himself. Now 2 out of 3 were encashed but the 3rd one dated 10th OCT 2010 didn't. I deposited that same cheque only twice but both the time it was same, now I am thinking of some legal procedure, what are my options.

Please help.
