Dear Seniors,

Does the accused have the right to receive POLICE Diary and exhibits of the evidence collected from the complainant without RTI.

or

What does the accused have right to get from the station except Case Diary.

WHEN A CIVIL SUIT IS FILED CAN ANY ONE PARTY CLAIM HIS SHARE?

my question to you is when a criminal
suit is filed during the filing
can the opposite party claim his share
over the said property as a whole
or wait till the case is heard in court?

we have a litigation going on a civil
suit so the above query is correct.

can a company sued

dear friends
i am having a ginning factory and i have supplied a big company cotton bales, as per the company policy they use to pay 90% of the payments third day thereby deducting interest,and rest 10% payments in fifteen days early trade was smooth but in the last of this season they blocked my money,kindly guide me to recover from the company.

Under which Section/ provision of Cr.P.C a magistrate can interfare with the investigation of a crminal case?

contempt of court

As per constituional law, any person outside the parliament house or any third person outside the parliament house is barred from publishing any proceedings of the house in a defamatory manner (be it the facts of the proceedings), however in law of crimes, an accused has a defence available to him to publish any defamatory proceedings in the interest of the public.

Please clerify the above two points...

Complainant filed a cheque bounce case with a certified copy of the cheuqe.

I want to know if any case laws/judgments that original cheque needs to be filed for the case.

Chargesheet Bail

what is chargesheet bail- Is it different than securing at the time of FIR.

I took bail in my 498A case at the time of FIR and the other accused took AB upto chargesheet.

the charge is submitted and now summons are not served but we checked the date in court so we would appear as dont want any adverse impact for non appearence.

The question is that since my parents are on AB which would not suffice in Trial court so on date of first appearence they would need to apply Regular bail application.

Is it granted or there are chances of rejection. My parents age is 70+ and my married sister. I want a honest opinion please suggest as I dont want my old parents to be arrested.

I have met local lawyers they dont give the clear picture as they think if they say its easy they cant ask more money but its important for me that the bail is granted. I am on regular bail being the main accused.

Petition u/s 156(3)

Hi,

If an application is filed u/s 156(3) to lodge an FIR but the magistrate dismissed the application of the petitioner then can the petitioner file revision of the order under higher courts.

Is there any judgements/ orders supporting this.
