Dear All

I am for the accused.

Complainant filed a cheque bounce case with a certified copy of the cheuqe.

I want to know if any case laws/judgments that original cheque needs to be filed for the case.

Original cheque is needed for the case.


Who had issued the Certified copy of the cheque? If the cheque is filed already in a court, certified copy can be filed.

at the time of filing the case the original cheque needed to be filed . But with the leave of the court if the case is not filed with original cheque, that must have to be produced at the time of initiation of proceedings.

They have to get permission from the COurt for filing copy of cheque and have to state where is the original Cheque

The court will not take cognizence of case untill and unless original cheque is not produced in court.

As the copy can be expected to be manipulated in any way, so the original with endorsements by the concerned banks is a must for the proceeding, as a proof of offence.
