I have filed a miscellaneous suit seeking restoration of partition suit [1993] which was compromised within 2 months from the filing of the said suit. I am one of the unborn legal heir at the time of deed and I am not a party to the suit for partition the stage is to hear on condonation of delay. Can any one help me with citation for delay in filing the miscellaneous suit?

MY WIFE IS WORKING AND FILED COMPLAINT AGAINST ME(506A).SHE DOESN'T WANT TO STAY WITH ME.WE HAVE A SON.LIVING WITH HER.
WE ARE STAYING SEPARATELY. AFTER HOW LONG I CAN APPLY FOR DIVORCE?.

Five persons were appointed by the Man power consultancy to serve in a Corporation/public undertaking concern. Later on after the Managing director retired from his service voluntarily regularised the services of the above said five person for the post of Catergory C & D as appointment for the back log vacancies for SC & ST person. The said members are his own family members who were on a contract service. By applying Umadevi's case the Govt has directed to cancel the appointment on various grounds a. that action of Managing Director is not according to KCS rules 2002, b. the appointment date is after the term of services as contractual employees, c. no interview was conducted nor their was appointment against the qualification specified by rules,d. Board members had not assented for the regularisation of appointment.
The said five person has challenged the action of the Corporation in Writ petition. An interim Stay is granted after 4 months of cancellation.
In the mean time the SC & ST commissioner has issued an Order directing now Managing Director to pay the salaries equal to the regular employees.
I want to know that action of the Commissioner is legal? If not what is the remedy?

Iam working in a MNC. I am married to a professional working in a MNC. Ours is a love marriage.we know each other from 4 years before marriage.And now in 2009 we got married.Its been a year that we got married.
These days we are having very frequent quarrels .Iam not sure why these are happening but he seems to be mentally torturing me and abusing my parents and I see that he thinks my parents are taking advantage though iam married and he wants me to dress up as he wants . he does not give me freedom to live like i want to live. I feel like iam livving a life in jail. He wants to make me live as his mother wishes.
He always expects sometihng from others which i dont like .I always opposed him drinking but he does not listen to me .
He does whatever he wants.He drinks thrice a week and smokes daily.He is also a spendthrift.He acts very well in front of elders and relatives so no one would belive him to be a bad person so iam suffering a lot.He was very good to me before marriage.I did not knew he would torture me this way.
These days he is harassing me mentally saying he is not liking the way i am dressing up or eating or moving which he did not have an objection before marriage or after marriage in one year. i did not change anything in my lifestyle the way i dress, eat or live.Still he is making me behave as in a orthodox family
He always mentally harasses me thinking my character is very cheap and he tries to scold me if i talk to my brother in laws.
Iam from a very educated middle class , very honest, good at academics and working as software professional.
I dont want to tell all this and make my parents feel bad because this was my decision to marry this guy.I dont have anyone to discuss all this as everything has his image as a good person.
Iam not able to live with this daily torture and do my work. i feel like going away but iam not sure how to do that .
Please suggest or advice as iam really getting depressed.

If husband can prove the 498a is false then what panishment for wife & her relatives ?
can husband can make police complaint against wife & her relatives who are filled 498a?
can husband get compensation for false 498a?

appeal lies to which court
Miscellaneous petition was filed before the principle judge junior division, Mangalore, Karnataka under order 9 rule 14 read with section 141 of civil proceedure code for setting aside of the partition suit which was compromised under order 23 I am a stranger to that suit. My miscellaneous petition was rejected on the ground of maintainability. Which court does the appeal lies under what provision?
