Unable to get Relliveing letter.

Hi Experts,

I was working in a small s/w firm in India [Bangalore]. Due to some personal obligation i had to join another firm in my native place , so i resigned from previous company , the company is having a policy of serving 2 months of notice period or buy back that period , i was ready for buying back the notice period , but the company guess abused me and dint gave me the reliving letter . now what should i do ? please suggest.

pay

can a private medical college can legally be asked to pay same salaries,perks,leave and facilities as given by govt. medical college in that state/central govt.esp. considering the latest judgement given by hon'high court delhi on 18 feb.09 in dr. gupta vs sunderlal hospital case where this pvt. hosp.is directed to pay same stipend to tainee doctors as given by govt. hospitals????

Full & Final Settlement

Hi,

I left my organisation on Dec, 2009, after serving a notice period of one month as per the company policy. At the time of leaving, despite of my request, nobody took the handover from me.

Then I handed over company’s belongings to my junior and took receiving of the same and sent scanned copy to HR at HO.

As per company policy the F&F gets done within 45 days but the process got initiated after 1.5 months.

Apart from my one month’s salary, company also owed to me the travel expense which i incurred for official purpose. Every time they came up with some or other query and delayed the F&F.

When i requested for full & final then company said that some of the equipment i.e. projector worth Rs. 40K is missing from the office and i will have to pay for them. Whereas at the time of leaving the organisation no such issue was there. Even in Audit, which was done by HO team, no such information brought to my notice while working with the company.

Now they have sent me the F&F sheet and deducting the amount under the head of INCOME TAX deduction and ADVANCE whereas they have been deducting the Income Tax every month and they DO NOT HAVE POLICY OF GIVING ADVANCE FOR EVEN OFFICE EXPENSE.

Moreover, they are not showing the loss of equipment under head of INCOME TAX DEDUCTION RATHER THAN ”Loss to Company”.

Isn’t it unlawful.

It is more than 3 months that Full & final settlement is not done.

Pl. Advise, how to take it forward.

legal advaice in service matter.

I am to state that in reference to the advertisement No.8-69/2000-HPKV(Rectt.)1-80089-210 dated 23.9.2000, I applied for the post of computer Clerk and passed the written as well as practical test but was not appointed. Through the RTI Act 2005 I reveived the photocopies of the proceedings of the selection committee constituted for the selection of the computer clerk and practical test. From the perusal of these documents, it is clear that the proceedings have been tampered and I have been debarred from selection by tampering the record.
It is interesting to know that Vigilance deptt. of Himachal Pradesh, Shimla has also made inquiry in this case but it is learnt that the case has been closed for the reasons best known to that agency. Through RTI, Act 2005 I received the outcome of the inquiry vide letter No.SV&ACB(E-3) RTI/Apeal/09-10887 dated 26.6.2009 in which inquiry official reported tampering in the proceedings of the selection committee but no action taken against the selection committee and justice not given to me. When the security agencies are not capable to provide justice then the persons like me have option either to tolerate the injustice or to leave the world.
I Jai Kumar Roll No 198 secured 49 (81%) marks in the written test and 19 (95%) marks in computer practical, but marks shown by tampering in the proceedings of selection committee are 11. This has blocked my future for no fault of mine.

Please tell me that can i file a case in high court and got my job back.

termination of employee who has put up 34 yeras of service a

respected experts,

an empolyee who worked more than 34 years in govt orgnaisation under non public fund which generates money on various ventures run by the govt orgnaisation and the employee manages /looks after the public service institute in which money comes from the govt empolyees monthly contribution towards welfare measure. the empolyees were governed by the non public fund rules and thier wages revised every after 10 years by way of ordering board of officers. The BOO inturn recommends revising of their existing wages along with any other consequential benefits.their empolyeemnt mainly based on the viability/healthy funds of the non public fund. now, the present status of service institute interms financial viability is very weak, hence the management.i.e.central govt orgnaisation has proposed to terminate her services with immediate effect and the orgnaisation is abide by the rules of the NPF and also ready to pay the gratutity towards loss of income.what are the procedures to be followed while trminating and whether an empolyee aho works more than 34 years has any legal right to move her gireveances in the court and whether they can challange the termination and any other relief she is entitled to that effect? please provide the rule position and and case laws in this regard, it will be more benefitial to the govt orgnaisation.need urgent advise. thanking all the experts who are all rendering thier valuble advises and saving the time and money.

Transfer Order

I am working in SBI in clerical post, In a meeting one male employee being arrogant used abusive language against me and pushed me, and when I fell down he snached my mobile so that I could not call any body. Branch Manager was present at the meeting.
I complained to police but they have done a routine inquiry and registered a general diary only.
I also complained to Higher authority of SBI and there was a departmental inquiry. Unfortunately 7 days latter I received my transfer order from the higher authority, I feel victimised. I have been transfered in a branch far from my house.
Can I complaint to National Commission for Women against my transfer order?
What step I can take against my transfer order?

Recovery out of Death Benefits..!!

Can a department(PUNJAB GOVT.) at the time of making payments(like gratuity/Ex-Gracia/PF/Leave Encashment and other payments) to the family of deceased can recover any outstanding payment pending against the deceased employee.... the dept. has marked a recovery mentioning that "some wrong increments were imposed in the salary of deceased in the year 1990, henceforth all increments imposed after 1990 were miscalculated" and so the recovery of same is pending(approx. Rs 1 Lac).....one installment(Rs3000/-) against the recovery was deducted in last salary drawn by the deceased employee... Kindly guide.
