Service compensation as per shops and establishment act

Dear sir/ Madam,. I had completed my service 4years 6 months in company situated in Hyderabad. As per shops and establishment Act, will I get any service compensation? Kindly clarify. I heard that any employee completed his 1 year of continues service will get 15days salary. So I had completed 4years 6months period.

Affidavit

I filed sca in high court of gujarat in July 2017. repondents prefer not to appear on the notice and court admits my case. in march 2019 respondents files counter affidavit for the first time since 2017. Is there any time limit to file affidavits in the courts . what is the time limit.

Non payment ff settlement after exit

I separated from RG Group on November,2018. Till then HR team assured for payment and by doing this they consumed my time and money. I succeed to apply for PF withdrawal on EPF portal recently after a marathon correction in PF account.

Please advice How Can I effectively do good for my self, I am ready to pay fees for this service.

Termination of services listed pvt ltd company

Hello Sir,
I am working in a Pvt Ltd IT company in Mumbai since Jun 2017. The company sent e-mail show cause notice for not attending office regularly and attendance shortfall of mandatory 9 hr 15 min to which reply was sent last month. In the meantime they have sent more e-mails regarding termination of services and to meet HR today. I have lost my ID card so they issued temporary ID card later security took it back. I received another e-mail show cause notice about attendance shortfall. Please reply is it legal for employee not being allowed entry office and given notice regarding attendance? As per the employment terms issued by the company at the time of joining if employee is asking to be released from services he s/he has to give 3 month notice, the company can terminate with 1 month's notice. In this case as I did not submit resignation they are terminating without intention of paying 1 month's salary. Kindly advise as the reply to company's show cause is due tomorrow.

Regularization of fte

Dear Sir,

i am working in one PSU as Fixed Term Employee for the period 5ys agreement consolidated pay. My recruitment process was completed as follows:
1. Recruitment notification published for the posts-18 Grade-3 in company website (i do not know exactly, notification published in Gazette and papers )
2. all candidates were applied for the post from our country.
3. candidates shortlisted, received call letters for certificates verification, exam, skill test, interview.
4. again shortlisted candidates received call letters for the Medical tests.
5. finally shortlisted candidates received Appointment orders.

Benefits have been receiving from our company:
1. ESI
2. EPF
3. Bonus
4. uniform

My post is newly created in our company. we are the first recruitment candidates. Till now, we have received one time salary hike, yearly increments and allowance. we are completed 1yr 9 months service. We are receiving monthly pay-slips. Form -16 also received from our company. One year probation period completed.

The same recruitment for the same post was completed in other states also. we are not confirmed by our company, Other state candidates got Letter of Confirmation. our confirmation also completed soon, because back ground verification and caste verification is on the process. Our Annual Performance Appraisal is not yet started.

Already manpower shortage continue, next 1 to 2 ys huge retirement in our company. i think permanent employees down to below 50%.

kindly tell ratio between permanent and contract employee in PSU in India.
Kindly suggest possibilities of regularization of my job.

I had lodge a grievance through online CPGRAMS portal on 21/02/2019, its status showing as under process. I like to know that how much time taken by CLC to resolve grievance.

Resignation Related Query

I am a State Government serviceman . Before my joining to the present post I have applied other state govt exam and passed . I have been selected and got appointment from that concern dept . Now I have been applied for resignation and release from my present dept through proper channel . They asking for NOC whether the exam already taken before my present posting , only one document verification process done during my present position . I have not intimated my present employer . Now They asking for NOC and telling without Noc you would be released . What should I do ? I've submitted my resignation with refundable money of Shortfall notice period . What should I do if they reject ?? Can any govt authority has the power to make myself bound to their service ?? Please help . It's urgent .

I talking about the state government to same state government .
For The same post .
My probation period is going on .

Payment of death gratuity

Sir, My father was a teacher in an aided govt college at sitapur. He was expired at the age of 59 years in 2009. Dept has paid GPF, GIS and pension to my mother. But payment of death gratuity is neither claimed nor received due to unawareness.
So, do my mother can claim it?
What is the GO for payment of gratuity?
What are the basis for claim of death gratuity?
Please advice.

Payment of commission on termination

Can someone please help with the below scenario?

I am part of a software startup where my sales commissions are paid in 3 phases. A percentage on order booking, a percentage on invoicing and a larger percentage on realising the revenue. After order booking, we invoice our clients on a monthly basis for usage of software (SaaS). Offer letter doesn't mention the duration for which I am liable to receive commission and the order can run into years until terminated.

I have recently have recently resigned from the company after receiving the purchase order for a large value. The company has said I am only liable to receive the commission percentage on the booking of this order. The percentages on invoicing and revenue for this order and earlier orders will be forfeited is what they conveyed. There is no mention of this clause in the offer letter or company policies.

What does the law say about this? Do I have a legal stand here?
