Service compensation as per shops and establishment act

Dear sir/ Madam,. I had completed my service 4years 6 months in company situated in Hyderabad. As per shops and establishment Act, will I get any service compensation? Kindly clarify. I heard that any employee completed his 1 year of continues service will get 15days salary. So I had completed 4years 6months period.

Gratuity is eligible if 5 years is completed.As per gratuity Act 6 months and above shall be computed as one year.Check up your eligibility with service record.

Plz refer sec. 30 of the Act which states about Leave With Wages. If any employee have worked for 240 or more days in calendar year, then he is entitled for 15 days leave with wages for subsequent year. And max. accumulation is allowed till 60 days, which can be payable as leave encashment at the time of termination of service. Plz check your whether the leaves are credited to its balance or not. The Act does not mention separate compensation of 15 days.
Regarding gratuity, the shop or establishment must have 10 or more employees for the Act to be applicable. Hence check how many employees are there in your establishments and actual days of your work which will determine the case. As per judgement of Madras HC, it requires 4 years and 240 days of 5th year to get gratuity, hence you need to calculate actual worked days.

1) What is the Nature of Business of the Firm?
2) How many Persons are employed in the Firm directly or indirectly or through or by the Contractor(s)?
3) As to whether the Industrial Disputes Act is applicable to the Firm or not?
4) What is your Reckonable Service?
5) Are you still in Service or you ceased to be an employee of that Firm?
6) If you ceased to be an employee, the reason for your cessation from employment with that firm in detail.

Please provide above information first. Then only it may be possible for any expert to advise you suitably

Below details for your reference:
1.we are merchant exporters.
2.Totally we are 6 members.
3. I think NO.
4. 4 years 6months.
5.I am not in service.
6.I got a another opportunity in different stream, so that I informed to my highers regarding this opportunity. They congratulated me. I asked them to settle my compensation, and they said ok and we will check and settle the issue in 2 days.

It may not be so. You may get gratuity if you would have completed 5 years of continuous services. Please check local laws.
