Dear Team,
Please advice on below scenario..
The management have decided to close one of our office and the employees will releived from their duties by FEB end.
Most of employees are employees for 3 - 4 years. As per gratuity Act they have not completed 5 years of service eligible but employees are asking gratuity.
Are we liable to pay grauity to the extend of amount accrued / deposited for these years.
Also furnish the relevant section from the Payment of Grauity Act.

Hi,
I am working in bpo (Pvt. Ltd. Company) , but getting only 12-leaves per year.
1. I want to know the actual number of annual leaves by law in Mumbai.
2. I have complained about this in BMC shop and establishment department, now what will be there (labour commission) procedures and effects on this company as I have complained? Will they charge penalty / they will seal the company / what will be the outcome of this complaint ? As this problem (I.e. Just 12 annual leaves) is with all the 350 employees will I be fired from the company?
I am tensed please assist.

Dear Sir/Madam, I have joined a company in last September, & as I have not received any confirmation letter, so I am currently on probation period as per employment letter. My query is that, recently I got opportunity in Government sector. So I had given 1 month notice to my current employer, now they are saying to serve 3 months Notice period or pay full salary in lieu thereof.
In Employment letter the notice period is separately mentioned to be of 3 months & does not mention whether it is applicable to probationary period or not.
I request you to please help me on to this.

i was arrested/detained by raiway protection force (RPF)under section 145- drunkness and section 146- obstructing railway servant in duties
(as written on that complaint paper
they deported me on other then my home state station and made a written complaint against me with my address, fathers name,age and i signed on that.
they also send me to hospital for checking blood alcohal level but it could not be completed. after 5/6 hrs with other petty offender(who travelling in ladies compartment)
they did necessary paper work and after some time asked for fine amount. even they(RPF) didnot produce us (with other offenders) before magistrate.and after
depositing fine they freed us and given my seized mobile and wallet after taking reciving sign from me. and they doesnot gave us any recipt of fine.
now my question is will i have to give this information in character and antecedent verification form in govt jobs asking whether convicted/
fined/prosecuted etc. i am afraid that if i not mention this they(employer/govt) terminate me if any time facts reveals in police verification.
i also could not conclude that whether it was fine or bribe.?
this is the whole story of RPF post only no magistrate no court even they given their bank account no to those which donot have ATM card and after confirmation of deposition of
fine amount they freed them and me.
sir is it possible that instead of producing me before magistrate they produce my paper in front of magistrate and the paper where i signed might be my guilty plea.
so, what i will write in coloumn prosecuted/convicted etc?
after reading newspaper i came to know that RPF can not lodge FIR and also can not make fine or challan on its own.
In complaint under Unfair Labour Practices Act,the complainant has admitted in his cross examination that he does not know the contents of his evidence Affidavit.
What would be the effect on his complaint.
Some case law would be appreciated.

I'm working in a government organisation. In leave credit I have causual leaves and earned leave..but recently I have given leave application for three days ( two general and one optional holiday) .my superior not sanctioned leave for option holiday.. But I availed due to some emergency.. So he treated it was unauthorized absent from duties and recovered one day salary.. My query is I have causual leaves in credit.. Intentionally he marked as unauthorized absent. Is it effect my career and what can I do ..? Please anyone suggest

I have been working as an Insurance agent in SBI life for the last 5 yrs. The company without issuing any show cause notice, terminated my agency and forfeited my renewal commissions. I was never given a chance to meet or explain anything as i was not informed that one of my policyholder has complained against me to the Chairman of the company. I was totally unaware of this but now frustrated to get this termination letter.
NOW, pl advice what legal remedy available with me. and i cannot bear big court fees to fight for justice. My complaint would be against the Chairman or the Branch Manager. And pl tell me about a service lawyer in karkarduma court, delhi. Thank u

Currently I am working in a private company yesterday I have receive a show cause notice from labour enforcement Officer so how can I reply of this notice
Dear sirs,
My officer asked me to submit a report regarding the misconduct of the employee that I mentioned in my query through SMS !!
Is it a right way to ask subordinates for a report through SMS that too for taking an departmental action against someone?
Does it a require a letter on such things so that I can have a documentary evidence for such instruction?
