Where to file the suit i.e. question of jurisdiction if died in one state permanent address in another state and living for working in third state.

if monthly salary was 3540/- exclude TA then how much compensation be expected to grant by court.
I have a query about an Educational Institute.They were running their (four) Buses to pick their students earlier.Now they have decided to make a contract with their Driver to operate all the buses on a abc contract amount and the repair maint/Running cost will be bear by the drivers.now Two persons per bus are deployed by the drivers to whom this agreement has been finalised.Now is there are applicability of EPF & ESi are there & how it will complied & who will bear it.

i have terminated from one companyin bangalore, i have served for 6 years , i have not been receiving salary slips. my salary was 11000/- pm , now while calculating the salary management reckon ony 4500/- for gratuiy by saying this is the basic salary , my question is earlier management not segregate this basic salary and my qun is they should reckoned 11000/- for gatuity, how you advise for this, i am r right to claim this amount
I am a Central Government Civilian Defence Employee, have completed my 5years service as LDC(Grade pay 1900/-). I had applied for higher (G.P.2400/-) post advertised (Employment News Advertisement Dated 17-23 July, 2010) through Staff Selection Commission. As per directives of DOPT OM letter mentioned in Swamy Book, I had directly applied to Staff Selection commission and had given intimation on same date to my Head of Office regarding this. My head of office has regretted my job application and intimated me in black and white and copy of same was forwarded to Commission without assigning any public interest behind it. Now SSC will not allow me to compete in this examination. I want to know (1) what are the options i have left to protest against this as my department has curbed my search of better employment even to other central government. (2) Can it be considered by Supreme court directly if this is the case of breach of my fundamental rights(Article 21&23). (3) Isn't it the violation of Human rights as rights related to life, liberty and dignity? (4) Why Government has empowered so highly the competent authority that prospects of bright candidates on open selection should invariably depend on forwarding of applications by the present employer to another Undertaking / Govt. Organization? Please help me with your reply so that i can sit for this and forthcoming examination advt. by SSC and PSC in near future. Regards

I joined a bpo company but due to illness i resigned after three month as doctor advised me for on month bed rest in that condition my manger forced me to join immediatly or resign. i resigned & sent my resignation letter to company on time along with my medical. Now after two years company asking to training exp. recovery & sent me legal notice through consultant (advocate). Kindly advise me what to do in this condition i have all document of my resignation along with speed post slip & courier slip.
they have mention the following clause.
if employee resign have to give one month notice period or one month notice salary. Company either recover training cost which up to 75000.00.
I have consulted service advocate he told me there is nothing legal they cannot recover the same as i m in probation period ( worked just three month )& have my all documents which show that the condition of resigned ( i.e my medical certificate, resigned letter sent to company along with courier slip & speed post slip).
advocate advised me that ignor this type of communication say postman they you have shifted any other location, need not reply.
Please suggest.

I'm working with a pvt. ltd. company since April 2008 as a retail store manager in Rajasthan. The company is engaged in the business of retailing of branded cloths. When i was appointed i didn't get any appointment letter neither service contract was filled by me. And apart from that i didn't signed any legal paper (stamp) for the penalties if any shortage occurs in the total stock quantity. I don't get overtime as i work 12 or more than 12 hours par day. I don't get either CL/PL. I don't even get national holiday off or compensation.
I've been promoted to operation executive 2 months ago, so i left the store i was appointed for and they appointed a new store manager over there. Now the problem is I've tendered my resignation with notice period which was for till 31st july 2010 but i'm still working in the organization coz they did't sattle my account and they just done an audit in the store and figured out a descripency in value and units which is around 6,00,000 and it seems to be impossible for me to pay. I did't get my salary for the month of July(They hold it their side). HR Man says we'll sue you if you don't pay such amount. What should i do now as i find myself helpless??
Can i take a legal action against the company for not paying overtime or something? What legal action they can take?
Pls help me on urgent basis?

It was during the initial stages of my career. I was offered a job with 4 months as a trainee without stipend and then the after that that i will be fixed as a permanent emplyee. It was all written on a 100 rupees bond paper and they also took a 10,000 rupes check as a security deposit.
The PB started when, even after completing 5 months, they did not started the salary neither i was told about the permanent Employment. It was after my often request to HR on the salary. They told me in the end of the 5 month that they will offer 5K after successfull Project completion.
After hearing this i just left company saying im not feeling well. And this was a very decision as i got a new job which was very good.
My worries are now that they have that check given by me as a security deposit.
This check was never encashed by them , but is there any way i could get that check back and also get the stipend for those 5 Months.

Our Company paying employee referal amount for giving new employee's Joining refernce i e 1000/- per employe. is it applicable for empoyee's ESIC @ 1.75 deduction on referal amount?

Dear Sir,
A company is deducting and contributing its contribution to the department for the employee whose salary is less than Rs 6500 per month.
The question is can a company give an option to the employee above 6500 pm salary whether to opt or not to opt the scheme under the EPF & MP Act.
Further if an employee is getting the salary less than 6500/- and later if his salary exceeds Rs 6500, i.e.previously he is a covered emmployee now later can he opt for being an exempted employee since he will be getting the salary above 6500/-
