NOT GIVING BONUS

Dear Sir,

This is in reference to my Bonus pending of Previous Employer.

My name is Mrinal Dutta from Mumbai.I was working with a Singapore based MNC. I have worked almost mre than 1.6 years and was a confirmed employee with having Appointment letter letter and confirmation letter too.

I left the company in the month of Aug.2010, have given resignation and notice period and company re leaved me with releaving letter and experience letter.

When i have demanded my Bonus for this Dewali they ignored this. I have put then mail regarding the same but there is no reply, saying that as per singapore rules company is not giving salary who left the company.

Is this true??
Please advise me for what to do in this case as my PF is also pending.

Retirement Age

Q. Is ther any retirement age mentioned under Delhi Shops & Establishment Act and Factory act, If yes, Pls. refer the clause or notiication no.

Irregular withholding of settlement dues after retirement.

In a peculiar case of Retirement of Physical Director of Railway Degree college, settlement dues were withheld for the confusion of Indian Railways Administration. The Railway Degree College is the only one college for entire Indian Railways and the Physical Director designation was also treated on par with other teaching / faculty (Lecturer). But one fine morning after enhancing the age limit for superannuation of teaching staff from 62 years - 65 years, the administration overlooked the post of Physica director and after some time delinked this post from teaching staff. Meanwhile the Physical Director or is immediate suprior or other higher ups were not aware of the change and the Physical Director was continuing in his services. The Physical Director accidentally when he saw the notification on an internet he immediately reported to his superior who in turn informed the Railway top officials at Delhi. Immediately when they noticed their lapse they asked the Physical Director to resign from the service. But while settlement came, they withheld the dues for the extended period of services which he has put in( served). The principles of justice during strike period say no work no pay. But for the ignorance of their own made rules, Railways are penalising a retired person and all his representations are falling on the deaf years of the Top officials who are sitting at New Delhi. My opinion is when we say no work no pay - when the department has taken his services during the extended period,that for no fault of the employee, the department can not withhold his remuneration and benefits which he eligible forthe extended period.Please comment.N.Murali

Notice Period

Dear Expert,

I work in a private bank. I had put my resignation on 26.10.2010 ,as I had asked for a transfer to another city but they denied and I had to leave this city by 26.11.2010.As per the rules.i have to serve 30 days as notice period.During the period 27.10.2010-31.10.2010,I was again requesting my boss for a transfer.After this was also denied on 01.11.2010 I continued with the resignation effective from the previous day.The same was confirmed by the HR.

Now my region head says that the resignation on the previous day will be considered void and the notice period has to be served from 01.11.2010.Please let me know if he can force me to do that.

My region head has troubled me a lot.He has transferred me twice within a period of 10 months without giving any reasons.I have worked in 3 different branches in 1 year.Please tell me if I can take some legal action against him.

Deduction from final settlement of deceased employee

Normally employees are taking various loans.
One employee of our company has directly taken loan of Rs. 175000/- from the registered Credit co-oprative society managed by employees of our company. After taking loan, within 4-5 months, the said employee expired.
Now Credit co-oprative society has written to Company Management, to deduct the money equivalent to out-standing loan amount from the amount payable to legal hires of the deceased employee and company to pay directly to said Credit co-oprative society.

The Company Management has stated that any money payable to legal hires of the deceased employee, will be paid to late. employee's nominee/s. And denied any payment by company to said Credit co-oprative society.

Please let us know the right legal stand.
Are we correct? in above stand.

service weightage & pay protection

An ex-serviceman joining in PSU after release from Defence service of 20 long years. weather he is eligible for protection of his seniority for all benifits of welfare like allotment of accommodation pay protecion etc. wether he can ask for similar accommodation and pay package if not higher than what he enjoyed while in previous service,?
