Fnf & relieving

My company is not doing Fnf & is neither giving me relieving letter stating that i have joined a competitor. The day i resigned, i sent a formal email stating personal reason or otherwise they would have never relieved me.I stated in my email that i want to serve my notice period of 14 days. They never responded to my email rather called me up on the conf room made me sign some papers and asked me to leave and said that you have been relieved. Now it has been more than a month almost i called them asking about my fnf and all and they responded that we have put it on hold as we have come to know that you have joined a competitor.This is not just with me they are doing this, there have been people who have left in the past and they are still waiting for their fnf settlement. I don't know how to deal with it. Please advise.

Termination policy

Hello Sir/Madam,

I have a query related to termination policy.
Currently I am working in an Indian Software Firm.
At the time of hiring I have put a condition that I will join the firm only if I provided with specific technology; as I have a prior working experience on that technology.
At that time they assured me that there are business requirement in the firm and you will get it.
But during training period they trained me in another technology despite the fact that I was asking them that I have a prior experience and would like to continue my career in the same skill set.
But again the HR and manager assures me that at the moment we don't have specific business requirement so you have to undergo the training, complete it and once you got the location ,you can ask to move into the technology you have experienced for as there are huge business requirement.
This business requirement comes just after allocation of my training stream.
But after reporting to location they are continuously forcing me to work on the other technology that I have worked on.
I also state them that if I will provide with the same technology I can work anywhere in INDIA.
I also agree to work as a fresher for the same technology , if you don't have any specific field of the same module.
I come to know that there are requirement in the firm but they are not providing me with the same.
They are mentally torturing me.
And asking me to take disciplinary action and then for resignation.

I request you, please tell me the right way how can put my things and ask to work on the skill set that I have experienced for and escape any kind of actions from there side.

Also please tell me if they take any termination action then what steps I can take to save my job.

Gratuity

Dear Experts,

I have one query.
If a employee joined on date 1.1.2005 for the probation period of 6 months.
then Gratuity will be calculated from the date of 1.1.2005 or after the ending of probation period of 6 months?

Co-workman in departmental enquiry

This establishment is a factory and have its certified standing orders. As per the provision of the standing order, any delinquent employee can take assistance of a co-workman in the departmental enquiry, if he so desire. In a case a delinquent employee opted for an employee as his co workmen in the enquiry he is facing. The enquiry officer gave his permission and recorded in the proceeding. The charge sheeted employee is demanding to the enquiry officer to send written communication to the Departmental head of the co-workman. There is no such provision in the standing order. Practice being followed is the enquiry officer only grant permission. It is the responsibility of the charge sheeted employee to bring his co-workmam.
Is there anything wrong in the practice followed? Whether the enquiry officer is required to give separate letter to the head of the department in this context? Kindly advise.

which shop and establishment law is applicable as the clinical establishment act is not applicable in the state of Gujarat.

Regd: leave policy for ites companies

Dear Sir,

I am really happy to get back to you. I have a big doubt. We are an ITES company based out of Tamilnadu.

I would like to know about the exemption act that an ITES companies have in Tamilnadu. Especially with regards to Govt. holiday do we have any recent amendment related to this. If so kindly share this at the earliest. We are US based company so we would like to list out the holidays list to our employees.

I would request someone of you to look into this and respond back at the earliest.

Registration under contract labour act

If an organisation employees 5 person as contract labour does the organisation has to apply for Registration Certificate under CLRA. Labour officers insist on Registration even if 1 person is employeed as contract labour in an organisation.

P.f.duduction

Dear Sirs,
In my previous companies I have performed as below :- Any staff who attends his 58 years then Company's share fully (12% )in P.F.column & Pension column is zero.

In present company One staff has completed 58 years should we continue his P.F. as mentioned above 12% & 12% E.E. & E.R.
Do We fill 10-D for pension & submit it.

Lien and technical resignation

Sir, presently I am working in central autonomous bodies and selected for central govt group A service. My queries are:-

A) Whether provisions of lien and technical resignation is applicable to me?

B)Whether I am entitled for pay protection. Presently I have Industrial pay structure.
