I am working as JE(signal) grade pay 4200 in Railways. During my service, i intimated my dept of appearing in the exam of JE( workshop) grade 4200 in Railways through all india recriutment exam (open competition). Now am selected in JE workshop, but dept (railways) is refusing to give NOC because of same grade pay. What should i do ? I have the receiving copy of intimation letter.

In 2012, CAT/Calcutta directed ERly & SE Rly to decide & consider my transfer in mechanical post in ERly. Accordingly IN THE YEAR 2013, ERly & SERly instructed me to submit transfer form. SERly also mentioned in their letter that my transfer form will be forwarded to ERly for my transfer from SERly to ERly. But when I submitted the said form in 2013, SERly did not forward it & kept pending for 2 years & finally had lost the said form from their custody. I again submitted the said form in 2015 which was again kept pending by SERly for 1 year & after that they again lost the said form like previous. SERly issued letter in 2016 informing the above facts & advised me to submit the same form once again. After submission SERly summarily rejected to forward the said transfer form to ERly due to shortage of staff though they initially stated in the year 2013 to forward the same to ERly.

Dear Sir,
One of my employee joined in my company on 1st june. But we didn't registered him in ESI act since our HR manager was on leave from 30th may to 8th June.
The employee met with accident in my factory on 4th June, so we registered him the same day in ESI though outsourcing agency.
Now, i have got show cause notice under section 68 of ESI act from regional director, ESI.
What should be the suitable reply ? Plz help

When a person was recruited based on written test and interview against open advertisement (in which there was no info about whether the posts are regular or contract scale) and regularized afterwards on completion of probation, how will his service on contract scale would be considered as temporary or adhoc. If it should be considered as temporary then can he approach the court asking for counting of contract scale service for the purpose of promotion and pension as he was selected following due process of written test and interview as in the case of other members who were given regular position based on same advertisement.

To call witness from respondent side I have submitted application to deposit PF, DM to court for summoning and almost three months passed which is kept for argument which is kept pending by respondent as they don't want to let witness appear. What can be done.

When a person was recruited based on written test and interview against open advertisement (where advt doesn't say whether it is for regular or contract) will he be considered as temporary or adhoc employee as per govt of india rules.
If he is recruited initially on contract scale and subsequently regularized can he ask for counting of his contract scale service prior to regularization of his post for the purpose of promotion and pension, when other colleagues of him/her are given regular position based on same open advertisement and selection procedure.

I have been an Indian based employee of the Foreign Mission,Chanakya Puri, New Delhi where I have worked for continuously 38 years in all sections including 3-times as Secretary to the Ambassador.
I am a senior citizen, retired from service. All the papers pertaining to my appointment are made by them in Arabic and kept in my Personal File in their custody. However, I have in my possession letters from three Ambassadors as a proof of my work performance and employment.
I have in my file bunch of correspondence exchanged with the Protocol Division of Ministry of External Affairs since 19-6-2017 regarding non-settlement of my Gratuity as per the prevalent Indian rules & regulations based on the old age retirement, with no result so far.
I am seeking your kind opinion and legal assistance to fight and win my case in the Labour Court and wonder if it will be possible for you to do so with complete details of the relevant Court, the approx. time involved and procedure to be followed taking into consideration that I am an old person having meager income now.
