Hi All,
Please guide and support.
Marriage lasted for 4 months, wife left matrimonial home after that and till today i.e after almost one and a half year not interested to join nor allowed husband to consummate the marriage during her 4 month of stay (giving excuses every time)
Husband files RCR with the intentions of saving the marriage after waiting for 8 months and after all requests.
Then Withdrawn RCR after 1 year of useless battle seeing no fruitful outcome and see their unreasonable monetary demands...in RCR petition and WS both agreed that marriage was not consummated but blamed each other and she mentioned that he unwillingness to join matrimonial home.
Now after a separation of 1.8 Months, she has filled Complaint in women cell Delhi this month. They have issued a notice to me and my parents.
This is the very first complaint or case from her side against me and my family, we have already attended first meeting in CAW and after first meeting we went for Notice/AB in KKD Court, but court after listing to both the parties directs to go for court mediation and have given a date after one month to settle out the situation, stating that there is a possibility of settlement.
We did went for first mediation but again over there as well they are demanding huge amount (LACS) from us which I seriously can’t afford.
Now in mediation as well the mediator is suggestion to sort out the case by money and gave two weeks time to both the parties directing them to come down in amount and vice versa.
Kindly suggest
What happened or will happen to our Notice/AB Application in Delhi District court?
Is mediation a normal route by court generally in AB request?

my friend is in trouble. his nature is very shy and calm and also his mother. No father. he married by 1 year and not a single day good with his wife. she is short tampered and sometimes very aggressive. she has big support from her family. she never intimate to him whenever wishes to go home. she always torchered him. she dont want his mother at home. and when he said he cant stay his mother alone she has gone to her house saying dont want to come again. what to do further? lot of quarrels happened and mother is not well also. He dont want to continue this relationship as much burden on work also. she oftenly ask for money as expenses incurred during marriage from him. he is the only working person in house. now demands are high. wanted the house named on her instead of mother. very big trouble. what to do next and fast. pls. advice.

Gud evening sir,
I was accused in false 498a case I came on bail and my family members got anticipatory bail just one week back I/O had submitted first charge sheet to the court.So, sir my query is that during trial the court will ask to produce evidence and witness by person who made complaint on me or not And incase if the complaint person did not produced the evidence and witness so at this situation the trial court how they will respond to this case. waiting for your valuable information.

I am 498a/406/34 vistim,i am bail now , bail is till feb,2013.
We have to get bail again in feb,2013.
In the meantime i talked with one person(over phone)
who is husband of one of withness, i also called him ,
he also called me.once we got fight over phone relating
to my child
If he show any adverse report on the date of bail, can bail be
cancelled ? we may get arrested?

My one of the party have problem regardin,
- Birth Property transfered to adopted child before adoption.
- Property held on adopted child's name on official record of govt. ( 7/12)
- can i claim or get back property transfered to him(adopted child ) before adoption.

My wife file complaint of dowry in women cell yamunanagar. After two hearing she file domestic violence case in court. After all of this women call me for investigation on her complaint. i went there and also give complaint against wife and her persent. I demand in complaint her first marriage divorce. This is second marriage both of us. Police investigation on my complaint? and if she hve no leagly divorce thn police hve power booked FIR aganist her?

Dear All,
As we know Orphaned grandchildren are not entitle for any share in grandparents property they are excluded by their uncles and aunts, irrespective if there are only uncles or only aunts.
Is there any exception to this principle, As i read in Hanafi law.
it will have been seen that the daughter, though nearer in degree does not exclude the brother's son or his son. Thus if the surviving relations be a daughter and a brothers son, the daughter takes 1/2 and the brothers son take the residue half.
It further says "within the limits of each class of heirs, the nearer in degree excluds the more remote."
Kindly clarify is there any exception to Principle of Represenataion of Mohameddan law, if only daughters survived and their is predeceased son's son.

I AM VICTIM OF FALSE 498A AND OTHER SECTION RELATED TO DOWERY AND DOMESTIC VIOLENCE.
ME AND MY FAMILY ACCUSED IN FALSE DOWERY PROHIBITION ACT IN 2012. MY FATHER IS EMPLOYEE OF SBI POSTED AT CHATTISGARH.
1. WE ARE ARRESTED IN ABOVE CASE 498A ON 31 MARCH 2012 AT NAGPUR, AND ON THE SAME DAY WE GOT BAIL.
2. ALL CASES ARE STILL PENDING IN NAGPUR COURT.
3. RECENTLY MY WIFE WRITE A LETTER TO TOP OFFICIALS OF SBI FOR SUSPENSION OF MY FATHER FROM POST DUE TO THIS CASES. IN HER COMPLAIN SHE HAS MAKING FALSE ALLEGATION UPON HIM.
4. IS MY FATHER VIOLATES ANY LAW OF BANKING RULES OF SBI SPECIALLY (RULE 56 (5) OF SBI OSR).
ITS MY REQUEST KINDLY GIVE YOUR SINCERE ADVICE ON THIS ISSUES AND SUGGEST HOW MY FATHER GIVES HIS EXPLANATION TO TOP MANAGEMENT.

False case for returning ornaments and money after divorce
Dear Experts,
My former wife filed a false case against me after divorce (Talaq). She claims that she gave me her gold ornaments and a lot of money to me and my parents as dowry (which is not true). She have attached my parents property in this case. She do not have any evidence submitted in the court other than her relatives as witness.
1. Please advice me what are the steps I have to taken for proving her claims are false.
2. What is the chances for me to win this case?
