(Querist) 09 January 2013 This query is : Resolved
Dear Sir,

please clarify me:

1. the Audio Recordings may be produced as a defence to nullify the blames of the petitioner.

2. the audio recordings may be produced as a proof by us to certify the blames which we are making on other person.

Devajyoti Barman (Expert) 09 January 2013
It is admissible in evidence if formally proved.
R.K Nanda (Expert) 09 January 2013
agree with expert Barman.
Raj Kumar Makkad (Expert) 09 January 2013
If the same is duly proved as per Evidence Act then the same is duly admissible.

Evidence Act is contained in law books so purchase that book and go through it as desired.

tape recorded conversation is held admissible if it is relevant, if the voice is identified and the accuracy of the tape recorded conversation is proved by eliminating the possibility of erasing the tape recorded conversation.

thanks Mr Sahni...
Advocate Ramesh (Expert) 10 January 2013
Surinder, eventhough you record the defendant voice how would you prove the particular voice is belongs to that defendant, whether that defendant is ready for expert test. So only when the defendant is ready to give voice for expert test regards to your recorded voice, then the court will take that expert report accordingly it will be taken as evidence.
Raj Kumar Makkad (Expert) 10 January 2013
If the respondent is not ready to provide his/her sample of voice for comparing the recorded voice then there is no use of such recording.
surinder (Querist) 10 January 2013
@ Mr. Ramesh and other experts..

Obviously you r true...

but this was actually my query...

if other person accuses me of something on any dramatic talk and i produce the rcording which actually contains what that other party said. so, in defending myself so, can i produce my such recordings as defencive proof or not...?
Raj Kumar Makkad (Expert) 10 January 2013
You can definitely produce such rccording in your case.
surinder (Querist) 11 January 2013
