Respected Members,
I recently filed divorce petition on the grounds of cruelty, she is not with me for the past 18 months. PLease enlighten me on the following points :
1. what are the steps in the process of the divorce, i mean after filing the petition steps involved up to hearings.
2. Regarding 498a/DV cases : presently there are is no case filed. But if she filed, what is the strength of the cases as they are filed after much delay and also after filing the divorce. Also there are no proofs for the same as nothing such sort of things happened. The main reason of the divorce is, she wants me to leave my parents and to transfer all the properties in her name.
PLease help me in this regard.

Here a case on crpc125. Wife got exparte divorce as prayed by her on cruelty/desertion. thereafter she file crpc 125 claiming maintenance for herself +child. Husband filed counter against MC,wife filed proof affidavit and enquiry is yet to start next month. YEsterday, husband managed to get a proof reg PREVIOUS EMPLOYMENT OF WIFE AS TEACHER IN A PRIVATE SCHOOL AND THAT TOO WHEN SHE WAS IN JOB on date of filing CRPC125, just after filing crpc, wife resigned the job. As it was not known to him when he filed counter, he was not countering her unemployment..... now he got proof as said above... under these circumstances, questions are as below:
1. Can husband file a addl/supplementary counter enclosing the newly got proof of her employment when she filed MC?
OR
2. Is it good to file it as an I.A or memo to reject the MC case...
3. should husband submit to court during cross exam?
4.any other views /advises pls

My marraige 1yr old, due to my inlaws and husband cruelty i have filed 498a case against them ,also i have prrof too.I just filed the case ,since then my husband is sending me sms calls to come back not forever but for 2days .I like him thus got married to him, but dint see the same.Just saw his cruelty all the time. I dont know what to reply him. it seems he is playing game but onthe other hand some part of heart emotionally wants to be with him. Need advice.

I was married on May 2006 and in March 2006 I applied for a property in an housing co-operative society and also taken two loans to pay my 2 installment and in Jan 2013 i got my property registerded with my savings of 4,20,000 and total property cost was 13,80,000 (40*60 site) and my loan amount is 9,60,000. Since my day of marriage is husband is not good to me but some how manage to spend 15days and he left me and returned after a week. As i leaved with my partents he is on and off (like 15days he will come home and later pickup fight and never returns for 15days some time for month) and finally he left home on Jan 2008 and my son was born on Jun 2008 after that he was back on July 2008 and again left my son and me on August 2008 when my parents deined to register the property as dowry to him. till date he is unseen and more over is a lectures in a college what legal action should i take. Seeking your kind guidelines as am silent he is taking for granted and demanding money from me and my parents and another point. Am working in an MNC since 2006.

Q)my second session of mediation is to be held on 18 of feb . i want that this should be my last session . can it be possible? i m sure my wife wont agree to my terms.

I was paying an interim maintenance of 8000rs per month, self with merchant navy,
working around 4-5 months in a year and totally stuck with other litigations, 498A,ipc 506,divorce cases.
First class judicial magistrate has ordered me to pay 30,000rs per month.
I did not submit my IT returns to the court fearing it will increase the present interim maintenance order.
also in section 24 HMA, divorce case filed by me, ADJM ordered a alimony pendilite of 20,000rs per month, that i have filed for revision at high court.
My in laws have produced a contract letter of mine from the year 2009, stating a salary of 2 lacs per month, contract period 3-4 months.
I am not a NRE, My IT return for last 2 financial years have been only 6.5 lacs per annum.
I am totally stuck with litigation and every month hearing.
I am planning to file my criminal revision at session court,will the court accept my IT returns now, which i had not submitted earlier.30k per month is impossible, please help.
My wife is a double graduate, she is giving false statements that she is still studying.

mah gf is being forced to marry a guy of age 38 while she is 21....she is complete against the marriage and she loves me..but i m not major, i m 20+. she told everything to her parents but their parents are not at all ready to listen anything and they are not allowing her to study also.. now she need immidieate effect or else everything will be ruined.. she want to know what are the steps to get rid of their parents as well as marriage..
1 .she wants to get rid of her parents .she dont want to stay with them ,not a sec also... what she will do.
2.she dont to get married...but she is been harrased from last 2 years and she completely helpless..
plz prefer some helps to regain the smile which she lost from last 2 years.....she also tried to commit suicide...but her parents saved her by taking her to thier family doctor ,and no one knew...

father has done second marriage after the first wife death he has two major children from his first wife out two one girl child is married and one boy child is unmarried father has taken flat in his own name and second wife name and some flat and shop in own name and boy child name after the father death if he do not make will document will the children will have any rights on flat of which father purchase on his own name and second wife name what other rights children have on property and investment which is made on his father name and his second wife name and will stepmother have any rights on property and investment purchase on father and children name please advice.

My 1st in-laws took away my son aged 6 years old, forcibly and were not giving back, when I went to get my child back, they were hiding my son and fought with me,with this I was mentlly dipressed,
1)when my child was in school I took my child without my 1st in-laws knowledge, from this can my 1st in-laws file a case against me?
2)Before they file any case against me, what precaution should I take
3)will I loose mothers rights on my child ?

Hi Experts,
I had posted a query asking for guidance on dowry harassment.

My husband now has filed DV on cruelty basis in his place.as soon as i got to know about this i filed RCR in my place. Now he is not taking notice of RCR case. n DV is in mediation stage. we are appearing for mediation in court his place. As I m working in other state n each time i need to travel a lot for these mediations, I m planning to take transfer to my place.
1. Please suggest what if dont appear for the mediation as m trying for transfer.
2. He filed DV just to escape from dowry harassment case, can i file dowry case now ?
3. If he is not appearing for RCR , can i get a court order to close DV ?
Kindly advice.
