My grand father is transfering a flat to my brothers but he want that it should be shared between all three grand sons.

1. what happens if HUF doesnot appoint a karta upon demise of its karta?
2. is there any provision/case law whereby eldest son is automatically appointed as karta.
3. If by Hindulaw senior most member is the karta, what happens if it does not perform his duties?

The Mutual consent Divorce through POA by wife and husband is proceeding in family court of India.Husband has job with lower income. Wife is in foreign country and well maintained herself and earning very well.But, Husband has no valid proof for her income because he is living in India and can not go and search in foreign country.
Que:1.Can husband claim during proceedings of MCD case, u/s.25(permanent alimony & maintenance)and u/s.26 (maintenance pendente lite & expenses)of The Hindu Marriage Act?
Que:2.Can wife claim permanent alimony u/s.37 of The Indian Divorce Act from husband though she is well maintained herself and divorce through mutual consent?

Sirs,
I am been separated after 30 days of marriage and living alone for the last 14 years fighting my case in the lower court. Out of the wedlock a female child was born and in the records fathers name provided is fictitious.
I wish to write a WILL, can you please advice, if it is legally valid if in the WILL, I write my movable and immovable properties on the names of my brothers and my spinster cousin sisters only.

Hi,
I married 5 year back . it was love and inter caste marriage(she is from upper caste and I am backward caste )and wife father was not agree so we run away and got married. I have 3 year son also. now their family convince my wife and they sent private advocate legal notice with False allegation. False allegations are
1. she has been physically and mentally harassed
2. she is not getting any money support for her and son
3. she has been asked for dowry from our side
4. she has been thrown out from our house after physical harassment.
Kindly help to fight with these false allegation.
note:from last 3 year she is in her parental house only two time came to my house that too of very short time.
I am working outside and away from home from 3 year and only meeting her during my vacation period.
she is staying with parent in different state and from there only she send notice to me and my father.
all the way of compromise has been failed.

Dear Expert,
i am working with a PSU Bank. My father in law alligated on me that he came to know that i have already started altering records to disapprove her daughter as wife legally. while i have not done any alteration in any form. now my question is:-
what all are the documents based on which i can disprove her as wife legally?
can i file case of defamation against him because he informed it at my official level by writing a letter there? he also wrote that i should not be transferred to my hometown other wise my family will torture her at my hometown
he also wrote that we have forcefully taken an undertaking from her that in case of her death etc we will not be held responsible.while it is not true.
what all are the action i can take against him legally.

Hi,
I have filed a suit for declaration of divorce u/s CPC 7(1)b. So called wife already took divorce by way of customary in the present of public notary and executed stamp paper for divorce now she is not willing to co-operate in the court. But she has orally on oath and in written admitted in all proceedings 498,Dv, Family court etc that she took customary divorce. So now i am looking for a judgement order of Judgement on admission CPC order 12 rule 6. On the same suit of declaration CPC 7 (1)b.
I request you to please help me.

Adive on divorce
My arranged marriage took place on 17th September 2011 , My in law has told us that my wife knows cooking , can handle the house independently and will live in joint family
We are 5 people , My mother , 3 younger brothers , 1 sister
After marriage it was known that she doesn’t knows cooking ,and avoid household working citing illness
She doesn’t take interest in learning cooking , and doesn’t talk to my mother and sister . stays alone in the room and chats with her sisters and mother over phone all the day
On complaining to her mother . she ignore the issue and support her
During the period of 1 year she has stayed more than 8 month in her mother house citing illness , Family function . She wants to stay separately near her mother house . Which I cannot as I have to look after my mother, sister and brothers
My Mother suffers from Arthiritis , In absence of my wife , my sister takes cares of cooking and house hold work , she is not willing to marry as she is worried about my mother and us
Her relatives are threatening to go to the court
Since last 1 year she is in her mother house . Now I or no one in my family want her back and i want divorce so what are the steps i should take? pls help me
Also i would like to ask what are the steps i should take to be on a safer side
