Under Hindu Marriage act, decree for divorce has to be filed after one year of marriage . But there are certain exceptions to file within one year. What are all the exception for the wife/husband to seek leave of the Court to file petition within one year?

Petitioner filed proceedings in family court for divorce decree. REspondent failed to engage lawyer in the next two hearings . So it was set ex parte . What is the next step for the respondent to proceed. Under which provision should he file restore petition ?
Whether vakalat for respondent to be filed along with restore petition of after filing of restore petition ?

any update related to:-
the issue of allowing courts to decide on doing away with the mandatory six-month waiting period for couples seeking divorce to move a joint petition by mutual consent. as it would help speed up divorce procedures.
Suppose some one want to take divorce within 6 month of marriage then ? or they have to wait for the same. for 18 months

Hello sir,This is regarding my wife,I have been married for the past 12 and a half years now i and my wife have been separated for the past 2 years i have two kids one is 11 years and the other one is 8 years.
My wife issue was that I fight,do not communicate with her and also do not help her in various issues,also she had issues on Facebook that i was charting with some foreign girls.
First she made a big problem in the house by not speaking to me etc,etc then she told me to leave the house and stay with my mother for 10 to 15 days i did what she wanted and when i went to work then she started to behave bossy she should tell me not to come home because she is in her parents house that is in Karnataka so i did whatever she wanted to give her space and time.But one day without my knowledge she sold the house which i had put in her name but all the money was mine when i brought the house from her mom and also did the house with my own hard earn money and she took all the thinks of the house the car and everything i was like a beggar she left to her father house and i with only a few clothes etc,then around 8 months she send me all of my clothes and my certificates that's all.She never worked after marriage she was a house wife.
After my father's death in 2011 she then started to behave this way because now that my mom is alone and she and my mom are not in good teams.
Also i used to send all my money to her even my credit cards and all the bank books was with her i did trust her a lot but did not know she will do all this to me.
Now for the past 8 months i have stopped all the money because i told her i need to buy a house for myself because i am staying with my mom and here the locality people know me and my mom very well,My mom is very devoted in church like almost famous and so i need to move out from here as soon as possible.But my wife keeps on treating me that she will kill herself and the kids etc,etc.i did not response to any of her mail nor did she have the courtesy of bringing the kids when they have holidays etc i have not see them for the past 1 1 /2 years.I told her last month that i need to see the kids then she started to say first send me the money then she write that i am troubling her and she needs a mutual divorce then she tell me that she is going to send a mutual divorce papers in which she needs my signatures,I told her that i won't sigh in any papers unless it is legal she tell me that i and my mom is mentally torturing her.
I know Sir that she has enough of money in fact she is more rich then me but she now does not want to reconcile or want to stay with me i guess.
Please advice me what to do and if it is good especially for the kids i really don't want to go for a divorce because of my kids but my wife i don't know what she is thinking Sir i really need your good advice.

sir actually my wife and her parents filed a false case of 498a,307.,3/4 DP act Etc.on 19 oct. 2011 against me and my old age parents.
then next day she filed 125 crpc and domestic violence case. my parents and i got bailed out not to going into jail for a second on 23 nov. 2012. the 498a case has not been charged it is in the trail court. on 11 july the magistrate accepted of 125 crpc and domestic violence and gave date for WS on 25th july. sir i am muslim and i want to know that i am not a qualified teacher but she said said in 125 crpc i am graduate and i am earning Rs. 50,000 per month in my own private institute teaching student but it's not so. my old age parents and i have been harassed by my wife and my in laws she was happy with me but in the influence of her brother in law she has done all these thing against my family and me she and her family wants divorce just but i said to them i can give you maintenance but not divorce 'coz i have not done such a mistake that i should divorce. recently i have taken the exams of +2 'coz i did high school just in 1993 and now recently passed +2 from NIOS in 2012 by which in the court when i surrendered before court submitted my exam card and got bailed out. sir at any cost i don't wanna divorce her even i should be killed by them so i want to ask max. how much i can have to give her maintenance and what should i should do against 125 crpc and DV so that i shuldn't give a single penny to her. i have no property but my father has house property and mother has 1 Bigha land
i have my bank account in which the will be around 1 lac Rs. sir please guide me thanking you
