Muslim law of inheritence of property

Dear All experts, this is in relation to the Muslim Law of Inheritance of family property, wherein among 3 sons , father during his lifetime, has distributed property among two sons and has deprived the third one, who is my present client. The two brother's got the immovable property registered and mutated in their name and at that time my client has given his no-objection under goodfaith. Now the brothers are not allowing my client and his family to enter into the premises. They are verbally asking him to construct a house on their land, but they will not give anything in writing. Is there any legal remedy for my client. Kindly help me to advice.

Summons

I lived with my wife in Haryana for 1 year and for past 3 years we are separated.My wife filed for divorce and maintenance in Mumbai at her parents` place.Maintenance decided at 10000 rupees which am paying regularly.Wife cross over in 3 sittings.My cross happened 6 times and lawyer and wife giving excuse for not finishing it and dragging it.I have to take three days off work everytime and now my manager asks me to take 6 months unpaid leave to finish case.Can I refuse to attend cross further?Will it affect my case?

Application for divorce

Dear Sir,

I am an resident of DELHI and currently NRI , Citizen of Australia from 2005 , My wife is also a resident of DELHI and currently NRI and Australian Citizen from 2005 and we have a son who is 6 years old and Australian citizen ,
My wife have come back to INDIA and while coming she also gave a complaint of domestic voilence against me at SYDNEY GOVT, I am put under probation by the Sydney police.
Afterwards she came to INDIA and is not coming back ,
Kindly advice if I have to go for divorce case , where should I applly - whether in INDIA or in AUSTRALIA.

Query about parting with personal information

I am a teacher in a totally private unaided school and am judicially separated with my wife and the case of divorce is going on. My wife is repeatedly seeking information about my PF account and the amount in it by sending application under Right To Information to my office. I want to know (1) Does a private unaided school fall under the ambit of RTI Act 2005? (2) Can my judicially separated wife claim a portion of my provident fund? (3) If RTI act 2005 is applicable to Private unaided Schools then Is the section 8(1) (j) of RTI act applicable to deny releasing my personal information like PF details to my judicially separated wife?

Difference between exhibit and article

Dear Experts,

When it comes to Family Court Act, whats the difference between an evidence marked as an exhibit or as an Article?

If a judge marks an evidence as an Article and keeps it as open (to be discussed during final arguments), does that mean that the evidence has not been admitted?

What are the positives and negatives related to the evidence being marked as a Article?

If this is a bad sign, would going to High Court be of some use?

About dowry and act323

after 6 months of divorce my wife has put complaint under 406 498 and 323 against me and my family members.. what should i do now i didnot got any summon from court .. can i go for antisepatray bail or i will have to arrest and then go for bail .. will court summon only me or all my family members whose names are in complaint..all of us have to go for bail or only me?

Divorced wife to get share in inheritance of husband

The recent ruling where an divorced wife can get a share in husband's inheritance...is this applicable in retrospective cases or will it be going forward?

the fact is that i file my return around 160000 PA and this is God gifted to me that i give coaching for English in my own institute and earn around 10000-12000 PM
and this is the one more fact that i couldn't pass the exam of inter in 1995 and i left my education then started my coaching center but ever since my wife implicated my family and me in false cases i thought to start my study then i passed the exam of +2 in 2012 after long coz i wanted to do law for 5 years but recently of BCI restriction of age i can not do coz i am 36 years old now.
she doesn't have knowledge abt my IT returns sir
this is to say of my wife that i am graduate and earning 50000 thousand bucs is false coz how is it possible a person can teach higher educated student who has been just tenth class.
sir i don't wanna show this is my coaching center i can show is that the owner is another guy and just i live there to look after and in exchange of that he gives me 3000 or 3500 rs to me
one of my friend on my institute letter pad can show my salery will it be gud or what else please guide me sir i can give her maintenance but not much coz i have my old parents spinster sisters brothers but sir because i used to love my wife a lot and she cheated me and my family i tried to get her back a lot even i touched the feet of my father in law and bu they refused be'coz of their elder son in law who is living at my in laws home after his marriage.
he is the main key to break my family
still i am facing all cases boldly and inshallah i'll keep on doing til the last moment of my life they have done so wrong thing for that i could have committed suicide but thouht had better that i should face the trial and doing sir

Domestic violence case judgement are applicable in circumstances or not?

in a domestic violence case i (Applicant) got one judgement in my favoure i.e. Residential order {order- all the respondents and their representative are restricted to enter the above said premises (matrimonial home)} but in the said case husband is not a respondent . Applicant's 3 sister in laws are respondent. after passing the order applicant got the possession of said room with the help of police and protection officers.
Now The said room was gone to SRA Scheme but in that scheme respondent no.1 (sister in law) submitted her documents becoze that time applicant's husband is out of India (before the Marriage of Applicant i.e before the marriage).
Now SRA builder started his work and given 2 years rent to all people i.e. Rs. - 2 lakh. Except the Applicant and demolish all area except Applicant's room till today.
Now i Just want to know that Applicant is entitled for that rent (Rs. 2 Lakh) or her sister in law. If yes then what was the procedure of that? What she will do for that rent and for that room? please help me and give me suggestion..........
