Hi there, i just wanna ask that my friends divorse petition is pending in Supreme court, the opposite party (female) is not appearing in the court even after repeated service of suumons & notices to her.Is there any provision in law to get divorse if the female is avoiding her appearance so as to delay the court proceedings.She has now agreed for a sum of money & filed a mutual divorce petition. what will happen if she withdraws her consent. I just wanna aks what should b done as she is playing very smartly.

I have estranged married life since last 8-10months. We(Me and my wife) don't talk or meet since long time. We are about to get divorce.
Whenever I tried to meet My wife for sorting out problem in between us, her brother and her family friend (Tantrik-mantrik baba type, who guides them in our issue) tries to harass me by telling me that they have filed police case against me for torturing my wife (of course its wrong allegation).
In past, My wife had threatened me many times to do suicide in case I'll leave her, these threatening happened a year ago. Moreover she tried to jump from my building (5th floor) in a heated argument - May 2009 Solapur,Maharashtra City (My residence near my old office).
Now we both stay at different cities. Can I, Now, file case against my wife for such threatening and attempt to suicide after 8-9 months in different city as well?
What kind of case I can file & what inquiry police can do in this case? Also Where I should file this case?
Please guide me. I'm waiting for your kind reply. I just want to have some legal proof with me in case she attempts suicide again.

Sir/ Madam,
My wife has submitted suit filed against me for maintenance.
If court will award maintenance of at upper side, my move will in high court for
Justification of maintenance.
In above case I want know can I pay maintenance at District court?
If yes, how much amount I should pay her?
I heard that I should pay half maintenance in District court until decision of high court
I am awaiting your valuable reply

Que.1.I Want to Know If Court can pronounce Ex-Parte Decree to Wife under Cr.P.C Section 125 in the absence of Respondent? If yes what would be the Maintenance Amount? If no Why?

My in laws has filed dowry case against me and i was also jailed for 17 days and got my bail. My parents are also accused. Now we reached to a state of compromise in which we have to give them a lump sum amount. i Want to know what is the most possible way of giving the amount to them....
1) My lawyer told me that when we submit the paper for resolution of 498a and other cases and for divorce, the court will give us a date of after six months, we convinced the other party that we will hand over the amount when we get the divorce order. Now the question is that they want to see a proof that we prepared dd or other medium.
As far as my knowledge is concern if we gave them copy of dd now and put original DD in our custody they can easily go to bank and tell them that they lost the DD and bank will issue a duplicate DD to them.
please help me that what will be safest way to overcome this problem. as they are not at all trust worthy... And they can go to any extent..... is there any other medium like Bank Guarantee or some kind of FD in which i will also having some control over the money so that once i will get the divorce i will release the amount for them.....

Hi,
I am an european woman married to an indian man from Bangalore, India. We have been married in my country embassy from New Delhi in august 2006. We have a baby boy born in Europe (the baby is an european citizen) of almost 3 years old. We haven't been married under the indian law. My husband left my country 2-3 years ago. He and his family wants me to come to India to show the son. I want to know if i can visit my husband in India (Bangalore) along with my child without having any problem coming back home (in my country) with the child, even without my husband consent. Is there any legal possibility for my husband to keep the child in India against my will ? May be in the airport, the indian policemen will ask me for the consent of his father in order to get out of india. Do i need such a paper from his father (being still maried) in order to get out of india, if the child is on my passport?

Can anyone tell me is there any act that forbids a wife from filing a maintenance petition either under section 125 of Cr.p.C or under personal law if the husband is dwelling in a foreign country?
